  • Acenden mortgage arrears charges

    I am having major trouble with Acenden (formerly London Mortgage/smpl/Capstone). We have a secured loan and unfortunately got into arrears. Acenden took us to court, stupidly we did not attend (due to fright/ embarrassment etc.) and they obtained a suspended repossession order. When the FSA made the announcement about excessive mortgage charges I tried to reclaim the charges added to this account. Eventually the claim was passed to FOS who unfortunately came down on Acenden's side . Their reason was that we never challenged the arrears charges added to the account when it went to court so they did not feel they could go against a Judge who had granted the suspended repossession order. I have been paying an extra £40 per month but feel I am just treading water. In March we missed a payment due to DWP stopping our pension credits, I immediately phoned Acenden to explain that pension credits would be restated and said I would continue paying extra £40 per month. They will not accept this and are again charging arrears fees, currently £70 per month. Our arrears have escalated to £2463 even though we have probably only ever missed 5 payments of £198.18. They have stated they will not make an arrangement and will continue to charge £70 per month. I have asked for a breakdown of this £70 but they won't give one they say this is commercially sensitive. We also have a PPI claim with the FOS at the moment regarding this account (£3400 upfront was added to account). I know most of these arrears are charges. Can somebody please help me with this - can this company carry on harassing us when the account is in dispute i.e. PPI claim? Should I try again to reclaim? Any help would be appreciated.
