    hi i bought a "new" phone today from a phones 4 u store i was not told at the time of purchasing that the phone had been used by staff and customers as a demonstartion phone.

    i know it has been used liek this becuase there are videos and pictures on it of the store and i never even turned the phone on.

    i would like to know if i have some sort of legal right to be told when a item discribed as new as been opened and used by a undisclosed amount of people

    Sales of Goods Act (SOGA) states goods, "should be of satisfactory quality, fit for the purposes specified and as described."

    If it was described as new, then it has been incorrectly described. I think you'd have a good case for taking it back and getting a replacement.

        You can ask! I think it may be harder to argue a discount than getting all your money back and a new phone. Good luck though! :beagle:

          the important thing to ask is, were you shown the phone and original packaging in store?

          the normal proceedure with a phone contract is, internet/phone (distance selling) 14days no quibble returns, after that within the first 28 days you send the phone back to the retailer for returns after that manafacturers warrenty applies.

          In store, there is no 14 days returns policy this is simply because you have the change to see and handle the phone before you purchase it, if on your contract it says Reboxed,.. that is a preused phone, although quite how the phone has photos on is beyond me as the normal proceedure is to do a full system reset and full service etc.

          If your receipt says reboxed, theres not a great deal you can do, and if you are not prepared to return the phone, then the possiblity of you recieving a refund is close to nil.
          At best, as Labman said, is a discount off your next phone.. and if it says on your reciept reboxed, that will be purely good will.

              The OP has stated they were not told it was used. Surely one shouldn't have to inspect things on the offchance they've been used when buying new. Equally, if they only had a (badly) refurbished one in stock, the customer should have been told this. Maybe I'm missing something? :beagle:

                Am I being thick? If OP doesn't want to reject the phone ,then he can't get a refund..or is there some clause (law) I don't know about. Every phone we have ever got as new has been in a sealed box,either cellophaned or has a sticky security tag on it.

                    With a reboxed phone, you seriously cannot tell the difference with a new one, its literally a phone someone has had and said Nope, dont like it, and sent it back
                    It has the 12 month warranty and has had the memory wiped etc.

                    It can be a normal remedy in a case of I want (in this case a samsung note) but I can't afford the full price call, agreed when I worked in the industry we had to say it would be a reboxed phone, and make sure they knew that this was the case. What is beyond me is the fact it got through the whole quality control side of the operation.

                    Legally the store have to show you the box with the un tampered seal, and some stores will actually open the phone and set it up for you all part of the service and all that. IF the phone is not what is to be expected and the reciept says NEW then they are in their legal right to return the phone as not as agreed, however if the OP does not wish to return the phone, it may be seen as being accepted as is.

                    as I said its the actual photos on the phone I don't understand.. with a rebox its a normal thing for the shop to open it and check its ok etc.

                    No disrespect is meant when I say its normally an option to save money, just an explaination of how this can happen.

                    If the OP will check their receipt, I may be able to assist them more, but I am 100% that no refund will be issued while they are in posession of the phone, and any discounts etc will be goodwill if the OP keeps the phone.

                      Personally speaking,if i paid full whack for a 'new' phone and it transpired to have been 'used' then i would hotfoot it back to the shop and demand a NEW phone to replace it. I am shocked that stores are allowed to sell 'demo' phones as NEW. Whenever we have had to go in mobile shop they use phones from a bottom draw which is full of 'spares'.

                        They are as long as the box and reciept are marked REBOXED.

                        How they sold it with photos is whats baffling me!

                          to let you know what has happened i have managed to get a 20% discount off the price i paid for the phone so all good

                            Have they removed the pictures for you? ALSO are you aware that with some providers, after 6 months you can "Upgrade" your phone on pay as you go? its a new thing and not many places are advertising this as yet!

                              yes i am aware of this but thanks for the advice

                              to just say to clear up a few things lol it was a pay as you go and the reciepte dose not say anything about it being re boxed or anything like that

                              the pictures are of the store and so is the video so they must have taken it out to show someone and then never restored it
                              i just through this was wrong and when i spoke to phones for you customer service they told me this is not there pratice and this should of never had happened this is why i got the discount

                              also the warrenty starts from the day i bought the phone so i have the full 12 months which is also good

                              once again thank you everyone as always you are all really good this thing is my new best friend i know alittle bit about the law (WELL ENOUGH TO GET ME BY) but it is always nice to check as i said thank you all so much
