Hi to everyone on the Barclays forum,

Some of you will have seen this story elsewhere but I would like to share it with 'Legal Beagles'

I was planing to take my son to see his elderly grandparents last month. My 'Court Bundle' was to be with the court and Barclays by the 19th of April, a date I planed to be away.

I thought it was time to make contact with Barclays and see what the chances of a settlement were.

Good Afternoon Krysta,

As you are no doubt aware I have the following claim with Barclays Bank P.L.C.

Claim No 7PL00126.

Plymouth County Court.

May 3rd at 10:00 am.

Under District Judge ****

I am in the process of completing my court bundle, evidence statement and skeleton argument which has to be with you, and Plymouth County Court by the 19th of April.
It is my intention to file these documents on Friday 13th of April as I will be taking my youngest son to visit his elderly grand parents from April 15th to 20th and will not have access to ether the Internet or good telephone communications.

My claim currently stands at :- £2,402.40p

Calculated as follows :- £1,780.00p Charges
£ 402.40p Interest @ 8%
£ 120.00p Court fees
£ 100.00 AQ fee

Total £ £2,402.40p

Please note you have received three copies of these charges on the 11th of November 2006, the 5th of December and also with my N1 form which was forwarded to you from Plymouth Court.

As you are know doubt aware, I am a litigant in person with no legal training. I have already expanded a considerably amount of time, money and effort to research and implement my claim and produce my 'court bundle'. If I am forced to spend more time and money on this matter I will be asking District Judge **** to consider my outstanding cost's in this case, i.e.special delivery postage cost on all letters and documents, my traveling expense's to and from court, the paper and ink I have consumed and my time thus spent @ £9 per hour.

As a active member of The Consumer Action Group and the Penalty Charges Forum, I am well aware of Barclays tactics of settling such claims as mine in the last couple of weeks before the court date.

To prevent us both from expending any more energy on this matter I require a repayment of £2,400.00p to stop this action from proceeding to court.

I am happy for this to be a transfer to my Barclays account as I wish to remain a loyal Barclays customer or by bankers draft.

This settlement will save Barclays the daily rate of interest of £0.39p ( as pursuant to S.69 County Courts Act 1984) per day since I filed my claim on the first of Feb 2007 and any costs deemed justified by Judge Moon.

This offer is non negotiable.

I reserve the right to present this letter at court.

I hope we can conclude this matter on these terms.

So off it went, I left it a couple of days and then rang Krysta ( who was very pleasant )
She put me though to a Mr Charlie Spalding ( also very pleasant to talk to) and after a bit of haggling he said he would send my claim details to the accounts dept.to check my calc,s. and would have a offer out to me the next day.

Fair play, the next day a offer turned up on the P.C.

This was exactly my claim, I dually signed the form he enclosed, crossed out the confidentiality clause and returned it by Fax.

I kept an eye on my account over the next couple of days and by the 17th the funds where back where they belonged

There we go, Barclays settled, Look out HSBC and beyond a 6 years claim.
