  • My hell with llyods tsb

    Hi for the past year i have been having trouble with llyods tsb. Last january i recieved a debt collection letter at my house regarding a £13000 loan to tsb.with me never had a loan nor been a coustomer of tsb i contacted them straight away to find out where this had come from. Turns out there is another john wardle with a differnt middle name but has the same d.o.b as me and lives in sheffield as i am from liverpool. So i explained that they had the wrong person and left it at that they said they would fix it. So i decieded to check my online credit report see if anything had been affected and to my amazement i had defaults on my file belonging to this other john wardle. So i contacted tsb and told them the problem but the service i was getting was disgusting at one point. I was asked on the phone am i sure am not this person. I was totally shocked so after months of telling them to fix this problem and getting no where. We decided to contact our local mp and we was disgusted with how i had been treated and took action straight away. Within a week or so i recieved a letter saying a important figure had seen my case and wanted to be personally kept up to date with this matter. So i was still recieving debt letters all through the year and it come to september when they finally removed the defaults and i recieved a letter saying that this would never happen again and was giving £1000 in compensation all together. So i thought fair enough thats the end of all this cause we had had a terrible year that year. My fiance was diagnosed with chrones diesase and she nearly lost her life to it. So dealing with this tsb couldnt of been a worse time. So a few weeks after everything i thought was fixed i recieved a debt letter through the post regarding a loan debt for tsb which i have multiple debt companys chasing me for this guys debts might i say. Plus me being promised on phone and letter that this would not happen again. So i was straight back on phone to tell tsb that this had happend again. They couldnt believe it had happend again an said he would sort it. So i recieved a phone call few days later saying all is fixed and you will never recieving anything again. Come to december and yet again i recieve another debt letter as you can imagine i was so sick and tired of this now. So yet again i was back on the phone to them and was told told this matter has complety been fixed now. So january comes and by the way me and my partner our in the middle of ivf treatment which is very stressfull on its own. I recieve a phone call on my mobile phone at 8pm last tuesday. Asking to speak to this other person so i replied speaking she said i am from credit secruity debt collectors and would like to speak to you about your debt. I told them this has nothing to do with me but they wouldnt give me any infornation on the debt unless i passed the security check. So she asked for my address and when i told her i failed because the address is in sheffield. So i explanied the situation an she said she would raise the issue. So i was furious as to how this debt company had managed to get hold of my personal mobile number. The only way they could of got it is by tsb actually giving out my mobile number with this debt. So i was back on phone and demanded to no how this debt company had my mobile number the guy was speechless on the phone and said he will ring the debt company and ask them to remove it straight away and now he has raised a investigation as to how this has happened. I told him i was so sick and tired of this now as he no's that this is are egg collection week in the ivf treatment. He said the only way to fix this is by wiping the debt which means the other john wardle would have close to £25000 complety wiped after me fighting this all year and i recieve £1000 i see that totally unfair. To make things much more worse i recieved a email from equifax saying changes had been made to my credit file on friday night. So i quickly logged on and to my disbelief tsb had put 3 defaults back on my credit file i was totally shocked. I feal physically sick with all this. Going thru the ivf is hard enough to deal with but to put this on us through absoulet incompitance is unbeliveable. We carnt deal with the harrasement anymore and was wondering if we actually have a legal case with tsb for harresment and the way they have treated us

      I honestly think you should sue them. They are clearly in the wrong, and despite your efforts have continued to act in a totally unprofessional manner.

      Someone else on this site has just won a case with Lloyds TSB for the incorrect placing of just two defaults and is in the process of negotiating the compensation.

          Any idea who i could see to proceed with sueing them.What type of solicitor would deal with this case. Thanks

            Write to your MP again because he is already on the case and explain clearly that they have for the last year, not only harrassed you but caused untold stress to you. Tell your MP that whilst they offered compensation and an apology, that their repeatedly continuing to not only put markers on your credit file but to send the debt to debt collectors who are contacting you.

            A further tip for you is this: everytime you get any form of debt correspondence then write to the CEO of lloydstsb on this matter.
            Currently the main man at LTSB is with this email address:
            tim.tookey@lloydsbanking.com

            Include a chronology and I would suggest you keep a copy of the chronology for further reference. This should not happen but clearly when the debt is passed to the debt collectors they are doing searches which brings up your name continually.
            If you choose to sue the bank, then I guess, others will have to advise you as I do not agree with doing that.

                  Definitely the MP, they need to hear individuals experiences to bring about any change.
                  (Slightly off-topic so apologies but...I hope the courts haven't got too used to the amount of revenue brought in from by companies with big legal clout. You browbeat people for too long and they'll give up, that's plain old economics).

                  Keep sight of what you need and that is justice for your situation, think suing further down the line if you decide to because you'll need a lot of organised paper-trail for that. One step at a time.

                    There is a firm of solicitors in Llangolyn, Wales who specialise in consumer credit matters, good reports of them circulate.

                    You could also instruct a barrister through the Bar Direct scheme, some memebrs of this site have used John Pugh of Liverpool.

                      This sort of madness is increasingly common. The halfwitted staff can't sort anything, and the computers carry on regardless.

                      Raise formal complaints with Lloyds again and also with the Ombudsman. Complain to ICO (Lloyds are maintaining incorrect data on you and are passing it on). Also complain to the credit reference agencies.

                      Make a formal SAR (Subject Access Request) under the Data Protection Act 1998 to Lloyds asking for everything they have on you, including ALL correspondence related to your complaints. This alone will show them to be utterly incompetent and can be sent to ICO.

                      You might find it worthwhile getting a copy of this other persons birth certificate. That, coupled with a copy of your own, proves that there are two different people. If you send that to Lloyds, and if they then carry on, you should have a cast iron case against them. You could even send them to ICO to prove the point - and that Lloyds and the DCA's have failed to make reasonable enquiries.

                      Don't send copies to to any DCA - they are so bent that they would probably use them for fraud.
