  • Help !!!!!!

    Please can someone give me some advice.

    I deposited yesterday £650.00 into my partners bank so that she could pay our rent by bank transfer. Barclays yesterday was not working properly online.

    Tried to transfer rent money today only to find all the money transferred was gone.

    My partner contacted the bank who told her it had been paid to BARCLAYCARD. She explained that we are on benefits and the money transferred was our housing benefit.

    We have been told by bank to contact barclaycard as there is nothing they can do.

    Barclaycard (Who are closed for the bank holiday) aren,t likely to give the money back.


    WHAT CAN I DO ??????? Please help.

    Why was it paid to Barclaycard, did they take it by direct debit? Was it a Barclays account you paid the money into?

    Why do you believe that Barclaycard aren't likely to give the money back?

      Unfortunately, as it was done by bank transfer, I believe that they do specifically have a screen which states that faster payments are not reversable. However, is the credit card now in credit as a result of the payment?

      Scrap the last bit of advice. Barclaycard have effectively taken the money via the right of set off. Can you clarify whether the Barclaycard was over its agreed limit?

        The Barclaycard was over its limit by about £200 these were charges.
        We have been behind on payments to her barclaycard since my redundancy.

          This may sound an odd question but is one thing that is kinda in the back of my mind. Can I ask why the payment was not sent directly to the landlord from your account(in hindsight I would have done this)?

            Barclays do this over and over again. best advice is to change banks away from the Barclays coven. They are a nightmare.

              Should also have stated that it was taken towards barclaycard debt. not direct debit.

                  But can it still be taken even if the money is not mine. Money was paid to me by the government. "Once transferred it belongs to the account holder" as quoted by my partners bank. So paid to barclaycard.

                    It can be taken if it's not yours since benefits becomes yours once they hit your account, your transfer to the other account meant they could take it. However, I would still complain to Barclaycard with regards to the fact that because of their actions, and they could have taken an amount to clear the excess, they put you in further hardship since the rent cannot be paid. Whether they would agree to give back partially some of the money, is open to interpretation by them, but still worth asking. A further point I would make is that I would open another account with a bank not Barclays for your bills and to perhaps look at paying the credit card weekly via direct transfer, ie 5 quid a week so that you are certain of covering the minimum payments.
                    Is there any PPI or income protection insurance on the card or is it simply charges and interest going through the credit card account?

                      On the other hand, there may now be enough credit on the card to buy a tent.

                      A further point I would make is that I would open another account with a bank not Barclays for your bills and to perhaps look at paying the credit card weekly via direct transfer, ie 5 quid a week so that you are certain of covering the minimum payments.
                      Use a standing order rather than a direct debit.

                        With regards to the last point ie standing order over direct payment, I'm suggesting paying at a time convenient to the OP, ie payday rather than a fixed date payment like standing orders, not sure if you have confused direct payment with Direct Debit which I am definitely not suggesting. I pay credit cards via online payments and at a date that suits me(payday usually or day after)

                          Someone more knowledegeable than me will fill in details, but I know there is a way of ringfencing money paid into your bank if you need it for a particular purpose so this can't happen. I just can't remember what it's called sorry.

                            It's called First Right Of Appropriation. You advise the bank before the payment goes into your account that it is Housing Benefit and to be used to pay the rent. However, as this was paid into davea66's account and then transferred to his partners account I'm not sure whether F.R.O.A. could still be requested.
