    In short, no, it is as yet untested and I would not recommend anyone brings a new claim based upon it for the moment.

      I know you from another forum(yourbank by another name). I was dying to ask you about the RBS and Public holidays thread....what happened in the end?

        FOS sided with RBS. I never bothered asking for it to go all the way to an ombudsman as it went between two different adjudicators and a supervisor and all of them stated the same. FOS are of the opinion that RBS have acted fairly within the rules, and that bank holidays are an issue outwith their remit.

        For those who aren't on the other forum, my complaint was about scottish bank holidays. I incurred 2 unpaid item fees on 2nd January, a statutory scottish bank holiday. I argued that I was unaware that the scottish banks had harmonised with england wrt bank holidays- I'm the wrong side of 30 and have never encountered this fact before- and argued I if I had been aware I could've arranged a faster payment to cover the direct debits. As a result of those charges I incurred a further 3 charges. I was on a DMP and claimed financial hardship but RBS rejected it. RBS refunded the two initial charges but steadfastly refused the other three leaving.
