        LETTER BEFORE 2nd ACTION
        Dear Sir/Madam
        ACCOUNT NUMBER: xxxxxx xxxxxx

I am very disappointed that you have failed to refund my charge after speaking to your advisor Surita at 09.20am 3rd August 2007.

As you previously settled out of court with regard to my last claim for charges, I was of the understanding that you would not want to incur costs if I started proceedings again. Unfortunately after speaking to your advisor she was not willing to agree to a refund, so it is with regret that I am forced to issue proceedings.

I am sure that it would be financially beneficial to both parties that court proceedings are avoided, as this was your reason for settlement last time.

I look forward to your positive response in this matter with 7 days, after which proceedings will be brought.

        Yours faithfully,

        P Kea
