Heres the story.
Around September 2007 my brother was the victim of ID theft and somebody managed to get a mobile phone using his bank card details to pay the bill. He reported this to Halifax as soon as he realised, but due to all the messing about they had him do, and the accusation that there was no fraud he stood the amount as it was only about £25 and withdrew the rest of his money from the account and opened another with Yorkshire who operate his business account.
He them immediately wrote to the Halifax (recorded delivery) asking them to close all accounts (he had 3, one with an overdraft). Following this he had no further contact to/from Halifax.
Then in Sept 2008 he had an email from Bank of America to confirm that payment of £26 would be collected via his Halifax debit card (the account with the overdraft) for some service he had apparently bought in the states. As he had closed the account he was not too bothered but contacted the Halifax to let them know about some possible fraud thinking they may want to investigate.
He was shocked to discover that the accounts were still open, but the lady on the other end of the phone said she would deal with it and not to worry. Guess what happened, the payment was authorised. He contacted the Halifax again to be told they would sort it. He then got letters from them and their DCA's demanding payment.
My brother has since wrote 5 or 6 letters and sent them by fax and recordeded delivery each time, the last one being in July last year, telling them he is not paying this amount as it is from a fraudulent transaction 12 months after he had sent a letter requesting the accounts be closed.
He had heard nothing since, until today when the Halifax sent a letter of intent to commence court proceedings (yeah right for £51.)
The original amount was £26, but with added charges and intrest is now £51
Can anyone suggest what he should do now?
