  • WendyB - v - LloydsTSB (more than 6 years old)

Having just read of Kate's win this has prompted me to start a claim against LTSB. We closed our account in 2001, having started originally in about 1998 with TSB. I know there were loads of charges on the account as in the mid-1990's we had a very rough time due to redundancy etc.

Does anyone know how far back LTSB hold records? And do I get this info by way of a normal SAR or is there a different template for pre 6 year charges?

Have had dealings with Sechiari Clark and Mitchell before, when we got into trouble with our (then) mortgage, so I know they fight dirty.....

have just won against Natwest on two accounts without going to Court, but I don't suppose thisone will be that easy...

Any advice will be gratefully received

    Wendy

there is a train of thought that you can claim back charges previously thought to be statute barred (past the 6 yrs allowed)
but with the oft case now in full swing you can bet that the banks will be using the statute to full effect
will reserch it fully but in the mean time i would hand fire

I think we can guarantee that i there is any sort of decision against the banks and a subsequent ruling from the OFT it will most certainly exclude:
      • All charges over 6 years
      • Contractual Interest

Even if the doubts still exist over 6+ claims, the banks/OFT will make it very difficult to go in front of a judge and win either of these two arguments.

Actually I'd forgotten all about this thread, but with the OFT case and so on I'd decided there wasn't much hope for it anyway. Thanks.
