          Hi Ed,
Well good luck with the hearing and please let us know how you get on.
Have you tried asking at the bank for your T&C's?

Yes, I even made it subject to a CPR18 request but they have failed to comply. I submitted an application to force disclosure but judge tagged the application hearing onto the limitation hearing.. Idiot.

              Ed,

I cant find very much written on LB about your hearing tomorrow. Do you have a thread on another site that I can have a look at ?

From what I can see tomorrow is mainly a CMC to disucss limitation act, doctrine of laches etc with your application tacked on to request that Judge order them to supply you with original T&C's. If this is the case then there isnt really too much to worry about. I presume that you have already prepared some notes for use in presenting to the Judge regarding your arguments as to why your claim should continue despite the Limitation act. The arguments should have been basically covered in the POC which you filed with your claim.

Here is an article which will give you a bit more background with regards to limitation and laches http://www.maitlandchambers.com/file...es.article.pdf

Thanks Budgie, I really appreciate it. I haven't posted a thread on this claim. I have posted on another site my personal claims on another site sometime ago, but I noticed some of the insitutions monitoring the site. I therefore took the decision to post this claim after completion as a historic record. However, I didn't realise how out of my depth I am until yesterday. I have been up against a barrister before. thanks for the info on Latches. Rgds Ed
