    Hello, I will try and make this short but no doubt it will be long.

    Background:
    This bank account (with overdarft) had been closed as far as i knew as it was combined with a loan account which is being paid through payplan to Intrum Justitia.
    The combined account is owed just over £3000 and is being paid at £15 per month.

    Charges:
    I have gone through all the guidelines reagrding my claim, SAR, prelim, LBA, and then received an offer which was about £250 short of what i was asking (£1100). I thought that to save time I would accept that payment as I could have used the cash. Anyway when i spoke to the person they said that the payment could only be made into the account. I told her that as far as I was concerned the acount was closed, but they stated that it can only accept payments. So I verbally declined their offer and will proceed shortly with Court.

    CCA:
    As part of trying to get my debts in order i sent cca's to all who i am payng with payplan inc Intrum Jutitia. From further reading am i right to believe that both a loan and a bank account overdradt require these docs? because basically the reply from Intrum Justitia said that they are passing this back to Natwest and are having no more dealings with it. The letter is similar to one I read on here somewhere. (this prompted me to post on here). Obviously this means that they have no cca, but is it likely that Natwest dont either or surely they would have gto a copy.

    Question:
    1) If there is no cca in existence what happens to the debt, ive read some banks write it off?
    2) Can I claim interest or payment back that i have made through Intrum Justita?
    3) How will this relate to my charges claim?
    4) Is it better to do the CCA stuff first then finsh the claim or vice versa. Cos if they write the debt off, then i claim my charges back surely they cant keep it then.

    By them not producing a credit agreement, they are basically unable to enforce the debt, except through a court, wherre they would have to produce the agreement to prove the debt exists. You would then be in a position to negotiate a settlement with NatWest.

    However, if you claim back your charges, you are acknowledging the debt? so I think it's one or the other.

    Intrum Justitia would just be collecting the debt on behlaf of NatWest, they will not have bought the debt so the agreement remains with NatWest and it is up to them to provide the agreement.

    Depends on how old the debt is really but they are not good at producing agreements.

          Ive been away for a while but I thought I would update you all.

          I have sent a CCA to Natwest and I am just waiting for the details.

          I have also got a copy of my credit report too just to check for any defaults by them or others
