  • Im New! and not sure what to do!

    Following a recent charge of £40 made to my abbey account for being £4 overdrawn. I think it time to have a look at my statements over the last 6 years to find out what else I have been charged for and whether this was fair.

    I know the first steps is to write to my bank requesting my statements which I understand they must provide under data protection.

    I then work out the charges (Is there a spreadsheet floating around to do this?)

    Then write back to my bank requesting the money back!

    I really dont want the stress of going to court etc, is there anyway to avoid this?

    Also as I'm sure with a lot of people out there, Money seems to be tighter and tighter for everyone. But I cant afford for them to charge me £40! That would buy me a weeks groceries.

    Hi an welcome to LB's. You can find a spreadsheet here in the link above.

    You need to send a subject access request under the Data Protection Act 1998 and include the stautory fee of £10 in the form of aeither a cheque or postal order.

    There is a copy of the SAR letter in the library on the site.

    If you don't want to go to court you could go via the Financial Ombudsman Service, however their is currently a hold on complaints being progressed due to a test case between the OFT and several banks and the FSA had allowed a waiver to banks meaning claims are on hold until after the test case. If you go court route or FOS then you will more than likely get your claim stayed or put on hold unless you can prove financial hardship.

        You probably will not get anywhere near a court room, but you must be prepared to see it through should you reach that stage.

        If you cannot afford for them to take £40 per charge from you, you need to stop them, but as I said earlier you need to be prepared to go all the way. They won't stop charging just because you ask nicely.
