    Statutory Demand from Lowell - WON!!!

    Hi Everyone.
    on the 7th of October I recieved a statory demand from Lowell for a loan held previously wiht Lloyds. I have asked on several occasion to product the letter of acknowledgement, agreement, statement and had nothing. the agreement was from March 2005.

    I have filled in the form to have the demand "set a side" and the witness statement. Now on the Statory demand it says "Any application by you to set aside this demand should be made to that court, which is "warrington CC. So today I went to serve my paper and was ask were I live. I told them merseyside, and thye have told me that I need to fil these in Merseyside. I had later called them, and I mentioned what it states in the later, but agin she informed me that it need to be in merseyside.
    Will this be correct.
    if so I can only finr Liverpool and birhenhad to file this.
    Hope someone can point me in the correct direction.

      Is there some way - such as getting the buggers done for contempt - by which those gits can be persuaded to abandon their dirty tricks?

        I'm actually not convinced its a deliberate 'trick'. The court system has been through a major reshuffle. Insolvency Courts are specialised and have been amalgamated into larger courts. Pretty much every case, I make a cursory check with the court to check they have correct jurisdiction. Approx 15% are incorrect. Most greater London County Courts feed their insolvency cases into the RCJ now, I just don't think BW 'have time' to check absolute jurisdiction on every case.

        A stat demand I took instruction on today only had 3 pages. 2 were completely missing including the critical one with the relevant court name listed! Now that was just caused by too much haste. I'm now acting on nearly 20 stat demands and they just keep coming. I'm imagining a bit of a production line maybe at BW Legal?

          Celestine should provide a pro forma letter that people can post to the LeedsLosers to advise them that if they wish to pursue their SD that she will be acting for the Defendant. A look at the success rate of them v Celestine should loosen their bowels sufficiently to withdraw their SD.

          Surely the time has come to take action against BW ilLegal

            I've invited several people to mention in response letters that I/PT have advised and that should they wish to commence legal action, we would be instructed.

                It does make me wonder whether BW ilLegal and other firms with similar MOs should be closed down in the public interest, if only to protect consumers.
