      I have 2 Catalogue alleged debts with NEXT and ADDITIONS.

      NEXT - Pre 2007 (2004) Send CCA in 2007 - Never signed it, still in my file with pre-paid envelope.

      - CCA requested 28 January 2012, was paying £1pm but stopped in March 2012 (Feb - Last payment)

      - CCA received 13 February 2012 , were they sent 3 CCA's unsigned, pre-paid envelope, and a letter saying that

      "Next are NOT required to provide you with a signed 'Executed' copy of the agreement and this is made clear in S3(2)of the Consumer Credit (Cancellation Notices and Copies of Documents) Regulations."

      - Moorcroft then took over and sent someone to my home (peering through my windows, down the side of the house, talking to my neighbours)

      - All letters that should have been sent have been, including the Harassment letters, all ignored and was sold to Lowell 26 April 2013

      - Passed to bw legal who issued SD 28 June 2013

      - Realised what it was after speaking to Paul late at night before the court which was at 10.30am the next day, when I decided to contact Celestine (not knowing who it what they did for a living), was saved completely from what you have read at the top of this thread, to being told I dont have to go to court, it had been stopped at the court car park!

      Absolutely amazing work by Celestine - Can not thank you enough!

      - Came home to find 2 letters from bw legal

      1) That they sent me the SD on the 11 July (not the 28 June) and if not heard anything by 1 August a Bankruptcy Petition will be issued by the Court.

      2) Thanking me for my email and asking for proof of ill health and attached an Income Expenditure & Proposal Form


      ADDITIONS - Pre 2007 (did have Littlewoods, Very, said there was no CCA and wrote them off)

      - CCA request 28 January 2012,
      - CCA received 2 February 2012 (Shop Direct)

      - Passed to NDR

      - NOA Lowell 11 May 2012

      - CCA received 28 October 2012, from Lowell and which was blank,
      - Completed all letters sent that follows CCA, harassment, Account In Dispute and sent all recorded first class (Same as the first CCA, etc)
      - Lowell passed to Red October 2012, who sent letters threatening but reducing the amount 45% and more!
      - Red instructed Hampton Legal November 2012
      - Red passed to Lowell (had the account all the time as they are all part of Lowell)
      - Lowell passed to Hampton 1 July 2013 - assessing my account to see what to do next
      - Hamptons letter 15 July 2013 - Disappointing that I haven't paid it back so they will try and obtain CCJ.

                What she does for a living is on her signature, she specialises in making SDs vanish into thin air and beating Lowell to a pulp!

                This is a trick they use very often, they send pre-dated SDs in the hope that people will look at the date and think they've missed their chance to apply for a set aside, lots of people on here have received SDs that were hand-delivered, yet dated 2 or 3 weeks early! :mad2: :mad2: :mad2:

                No idea how the OFT allows them to keep their Consumer Credit License. :rant: :rant: :rant:

                    I got that after the event as I was trying to find help for the 2 hour window I had (which wasn't even 2 to be honest, as I was trying to get dressed, look and change my forms around online with Clestines help and busy panicking!

                                It was an absolute pleasure to be able to help Trixie out on Monday morning.

                                Once I had spoken to her on the phone, I was very certain that her medical situation meant she was highly vulnerable.

                                I'm lucky in that I am now well known to the staff at BW Legal who issue these Statutory Demands for Lowell Portfolio.

                                I also knew that Trixie had a s.78 which had not been complied with from a long time back.

                                With this information, I simply called BW and asked them to consider withdrawing the SD due to Trixie's poor health and vulnerability as well as the matter of s.78 non compliance.

                                BW were very quick to agree, so long as they didn't incur any costs from my current law firm. As it really only took me 3 phone calls to resolve, I was more than happy to agree.

                                In fact this week, Ive also set aside 2 other stat demands due to non compliance with s.78.

                                It just goes to underline how powerful a tool the s.78 request can be when used correctly and firmly. In the case of the other 2 SD's, Lowell agreed to set aside IF they couldn't produce the documents within the statutory TWELVE day period! This creates a nice, tight timescale and the statutory demand can be set aside even before the 18 day deadline for making a set aside application.
                                This quick response can save a lot of time and costs for both sides.

                                So if you have Lowell chasing you for an old credit/catalogue/loan account, the s.77-79 request is an essential tool to defend yourself from bankruptcy or CCJ.
