Urgent - lowell/bw legal statutory demand in court in 2 hours - WON!!!

  • Urgent - lowell/bw legal statutory demand in court in 2 hours - WON!!!

    Hi,

    This is probably going to be impossible but, here goes, I have received a SD hand delivered (not handed to me) by bw legal for bankruptcy over NEXT Catalogue debt £1.4k at 10.30am today!

    I was told UE, which it is and pre 2007, 2004 to be precise, never signed a CCA, I haven't been paying towards this since I joined a group who use UE and was told it wasn't important and that they wont do anything as its a Catalogue and no evidence with the CCA requested January 2011, received 3 CCA's with a pre-paid envelope. Paid £1pm till March 2012, they have sent me a CCA back in October 2007 (still got in my file never signed) out to me to sign after I requested a copy of my CCA, even gave me a pre-paid envelope! Has been sold to Lowell and they have got BW Legal to deal with it.

    I received 28 June 2013. Its past the 18 days due to me being very ill (long term) on a lot of controlled medication so I dont know what I am doing half of the time and its hard to understand things. I am using a good Solicitor well know to this forum for another matter and thought I had asked him for advice when in fact I didn't, instead send a message about other rubbish going on in my life at the same time.

    I have got something written down but not enough and not how it should be after talking to the solicitor very late last night. I didn't realise what it was and I thought I had asked about it and then I asked someone else who has given me the information I am going to have to go in with today!

    I have been told that I need a good reason why the 18 days have gone by without me sending anything to the court, I have to go with the truth of being so ill and in and out of hospital all the time. The medications I take, and thats about it. What else can I say? I did also email the company who sent an automated response that this particular man wasn't in the office till the 5 August 2013, so no reply from him! I did then forward to the name he gave on his email who was dealing with his cases till he is back in the office.

    I think I am going to need a miracle today to keep hold of anything and not be declared bankrupt. I dont understand how these people can do this when its a clearly UE, unsecured debt with no evidence at all of there even being a CCA of any kind.

    I do also have another Catalogue with Lowell chasing me with Hamptons this time that needs a response sending today as I dont want to have to challenge two things if I manage to somehow defend this today! I also then have a CC that has now been sold to Lowell from the Halifax.

    If anyone knows of a template letter or legal information of any kind to defend this today I would appreciate it so much... I know time is very much against me and this is a very long shot but, I need to try anything!

    Sorry I may have misunderstood.....

    How can you be in court in 2 hrs, If you have't made a set aside application?

    I've PM'd you the best wording I have on setting aside a stat demand xxx

                      A miracle happened in the form of Celestine! I have never had someone act so fast at such short notice and stop the whole thing as I arrived at the Court car park! Completely speechless I have to say not just the one alleged debt but sorted/ing 3 of them with the same company!

                      If there is ever a site who can help its this one. The lovely Celestine not only sorted this out but spoke to me and calmed me down and made me feel like someone actually cared about me and my problems, absolutely remarkable, and against all odds made Lowell stop and withdraw their application.

                      Thank you a million times for your help and being the only one to ever make me speechless! lol If I would have know this lady earlier, who runs this site in order to help so many people, like myself, I would have been more in control of my life and less concerned, making the stress that I have been under go away.

                      The bad news in this is that i think maybe the combination of being so ill and the stress before Celestine stepped in I have had a further TIA/paralysis disorder that I have affect my right side, mostly my arm/hand and my speech, the latter seems to be coming back but not my right arm and hand.

                      Thank you Celestine for your incredible speed at which you stopped me from being made bankrupt and just everything you did. I am still in shock with it but, so happy I contacted you. xxx

                        indeed its pretty rapid, although my best is 11 minutes from notice of acting to consent order abandoning lol
