  • are judges blind now?

    Have I done something wrong.

    Really baffled by a stat demand set a side refusal.

    Contact with the court and they say to write in, is everyone in these departments idol and lazy, I'm telling them the problem on the phone, why do I have to write in, why even bother to have a telephone.

    Filled in all the set aside paperwork with help from the court lady on 6/04/15, told I would hear in 5-10 days.
    Just heard today, that it was refused.

    debtor gave no reason or evidence.

    On the set aside paperwork I put the reasons, abuse of procedure and debt disputed.
    I also gave copy of dca letter saying they do not have any documents and the debt is in dispute.

    The stat demand dated 5th march 2015 states they bought the debt in nov 2014, surely the judges can see that is not time enough to exhaust all other methods before issuing stat demand.

    Do I not get a hearing to put my case, have I done the paperwork wrong.

    I feel like giving up, take my house, there is zero equity, take it and let the government keep me, what a f**ked up system, why does every other country want to come here.

    Ok firstly did you file the correct papers with the Court?

    If so, you should have filed a witness statement setting out the background of the case, and your evidence etc plus all relevent documents should have been exhibited to the statement too. If you failed to follow the rules you could now be facing a petition, however all is not lost BUT you will need to file the corrrect Court forms correctly completed otherwise you could be bankrupted

      Thanks for taking the time to read this.

      I assumed all was done correctly as the clerk told me what to put where.

      Thanks for your help, but I can't really be bothered to do any more and they can do what they like.

        Rolling over is something i would never do, its not the end of the road and to be brutally honest you are simply cutting your nose to spite your face.

        The Court cannot ever give legal advice, first problem, so you need to dust yourself down and get on with things, of course you could just let them bankrupt you and take all your assets etc, your move now but i know what id be doing!!!
