  • mkrr/mkdp being un-responsive

    hi guys,
new to here and been reading the comments on mkrr/mkdp. i also have a few issues that i need help and advice on with this company.all advice would be greatly appreciated.

i started recieving phone calls 3 times a day out of the blue from this company a few months ago demanding my personal information to carry the call forward. this i refused to give and sent a letter of harrasment off to them.

The calls stopped but they then started writing with demands for re-payment of £168.10 from an original creditor called HFC. i had never heard of MKKR/MKDP before or HFC. after 3 letters with no explanation as to why or the alled debt had occured i sent of a subject access request to them registered delivery.

there response has left me in a quandry on how to reply to them as i have no legal knowledge on this.

they replied that they could not help me as i stated it was a fradulant debt. i never stated that. i only stated that i had not heard of either company and had never recieved any correspondence or statements from such companies.

i also have to contact HFC personally by letter, send a copy to MKRR and an update within 10 weeks or they will pursue the debt once again.

They cannot supply me with the requested SAR as it is a fraud case, again i never once stated it was fraud.

i also enclosed a postal order for £10.00 (refused to send a cheque so not to give them my banking details) to cover their costs. they said this would be refunded to myself, but the balance of the alled debt has come down £10.00, so i think they have taken it off that!!!!!

i thought it was there job to prove this debt actually exists. i am not willing to spend my time and money chasing up this non-nense if it is their job to do this.

would like to write them a snotty letter, but do not know what to put in it really as i do not know where i stand on legal terms.

i have never had an dealings with HFC in the past. all help and advice would be most appreciated.

    Hi and welcome

I'd suggest sending a prove it letter, you'll find one here: http://www.legalbeagles.info/forums/...034#post472034

Send recorded so you have proof. That should put the onus on THEM to prove the debt or shut up! :thumb:

thanks flaming parrot for your reply.

the prove it letter is great, but there is a point i missed out in the original post unfortunately.

the company has stopped communication b telephone for 3 months.

since the SAR request, where they claim it is a fraudulent debt (i have never claimed it to be fraudulent) they have ceased all communication for 10 weeks.

basically they are sitting on their backsides doing nothing expecting myself to sort this all out for them and claim all the information.

i am just confirming that i am right that they have to prove the debt themselves and not just try and bluff about them not being able to do it themselves.

Basically if they don't contact you again, there's no need for you to do anything. If they do, then you ask them to prove the debt or go away, it's up to THEM to provide something that shows you owe the money, otherwise I could also write to you asking for £168!
