    Hello Everyone

    HELP !!!!!!

    I am new to this site and thank goodness I have found you.

    I was wondering if anyone can help ?
    On Fri 6th June a man knocked on our door at home and handed my husband a letter for myself for a Statutory Demand from a company acting on behalf of Cabot.
    It says : A Statutory Demand issued under Section 268 (1) (A) of the Insolvency Act 1986.

    Could anyone please advise me what to do as I have never received one of these before ?

    Do you know what type of alleged debt it relates to? Credit card? Loan?

        More details would help.

        - Do you recognise the debt and/or have had previous correspondence on it?
        - Amount (roughly)?
        - Type of debt?
        - Is there a dispute regarding the whole or part of the amount claimed?

          Hello guys and thank you for replying.

          The original debt was NEXT DIRECTORY for £1417.26.
          It was then sold to Moorcroft (I sent them a CCA and they didnt have requested info and sent my £! chq back)
          It was then passed to Roxburgh, then NEXT again saying they had sold it to Cabot, then Apex,Cabot again,Fire,Hassall Solicitors and now a company called Kenyon &Co. Ltd who hand delivered this Statutory demand !!
          Oh and the amount has increased by Cabot from £1417.26 to £1601.30 (interest at 12% per annum)

          I am a carer for my disabled husband btw and we are home owners

            Thanks. When did you open the Next Directory account and when was the last payment on it made?

              The account with Next was in 2006 and the last payment was made in Sept 09 to Moorcroft
              It was then I asked for a CCA request and they didnt have any info

                    I would question that I owe this amount of money to this company but |I will accept the official demand when it arrives on Wed 11th June

                      Good decision to accept the demand, the process server is very much the messenger in this situation.

                      The most important step now is to send of a s.78 CCA 1974 request. This action alone can stop the bankruptcy process dead.

                      It sounds like this account has really been round the houses so it will be interesting to see if they produce anything.

                        Hello Kate,

                        Thank you for your prompt reply.
                        When we received this hand delivered notice of impending SD it was Fri 6th
                        The next morning on Sat 7th I immediately dashed to the post office before lunchtime closing and sent an s78 CCA 1974 with £1 chq request to CABOT and sent this recorded del to be signed for.
                        I have checked the Royal Mail track and trace this morning Mon 9th and it says that the letter has been delivered to them.

                        So now CABOT have my request

                        So now awaiting Statutory Demand on Wed 11th.

                        What will happen now do you think ?

                        I had never heard of Statutory Demands until last week

                              Hi guys, update.......today is the date the STATUTORY DEMAND is coming.
