  • Just about to take a company to court but before I do ?

    Hi all first post so sorry if it,s in wrong section,
    We are just about to take a person/owner of a company through the court system, so I thought I would pay for a check to see if they had any other judgements, it seems they have one already, So is there any where I can find out what they where taken for ?? I have the case number the court and amount date etc, it is a Unsatisfied JudgmentThe reason I ask is am nosey No, I would just like to know if it was for the same sort of thing,
    Taking payment and not supplying the goods

    any help thanks

      The Owner, its a one man company, with the home as office address,

        Before you take action bearing in mind he has an unpaid judgement are you sure he has the will or the money to pay if you get a CCJ Is he a sole trader or a LTD company?

          The owner and the company are completely different legal entities. In law, a company is a person in its own right.

          If your problem is with the company, then you cannot normally go after the owners. The owners are the shareholders. Directors may be shareholders as well, or may be mere employees, albeit with certain responsibilities. Only if there has been a serious crime, is it likely that the court will hold the directors to be indistinguishable from the company.

          Many claims fail because the wrong target has been selected, so you need to be absolutely sure who you are going after, and why.
