Halifax/RBS/1st Credit/CAI Finance Ltd

  • Halifax/RBS/1st Credit/CAI Finance Ltd

    Hope that someone out there can give me some advise please.

    Back in 2001 my partner opened a personal account with the halifax building society,
    After approx 12 months I went on the account he had by then started to use this account for his business , this was roughley 2002 /03. I went on the account to help my partner as he was working long hours and was not always able to get to the Halifax to withdraw money for wages or after a long day want to sign cheques to pay bills. I did this to help him, I never drew any wage or took any payment from the business account.
    I can not remember ever having signed any agreement when I went on the account.
    After 2008 the business collapsed, due to none payment of a large job that had been done, there was a 10k overdraft on the account.

    The account now owe's over 9k, alot of which is made up of bank charges on the account which was frozen in 2009 this debt has been passed to various collection agents. For the last year we or should I say I have been hounded by

    Connought, 1st Credit, and then CAI who have now issued me with a Creditors Bankruptcy Petition and have set a court date in July.

    This petition was delivered to me by hand and not in an envolope on Friday morning 21.6.13, in the name of CAI Finance Ltd of bedford Row in London. On Saturday morning (yesterday ) I recieved a letter from CAI finance dated 19.6.13 saying that the debt had been assigned with "all respective rights,titleand interest in respect of the above account" to 1st Credit Limited,they are based in Reigate.
    How should i proceed, they originally persued my partner, after not receiving payment from him who's debt this actually is, it went quiet for about 12 months, since then they have been persuing me and me alone. Is there anything that I should ask them to provide can I challenge this where do I go from here.

    I have also had a letter from the Land Registry addressed to property that I lived in befor I met my partner trying to track me down, this property has a halifax mortgage on it, it is owned soley by me, which is not in arrears nor has it ever been.I have NO other debt apart from my mortgage.


    Sorry this is such a long post but if anyone can give me help on where I go from here it would be much appriciated as I really want to get this sorted out as I seem to be constantly worrying about this and my phone does not stop ringing with calls from them, please Help.

    Did you ever receive a Statutory Demand? They will have to issue one before proceeding with a BR petition: http://bis.gov.uk/insolvency/persona...one-bankrupt#4

    To make someone bankrupt, you have to present a bankruptcy petition to the court, and prove that you are owed at least £750. You can show this by having an unpaid statutory demand or an unsatisfied execution of judgment
