    from reviewing this thread, despite the fact that some of the HMRC debt was disputed some of the debt may have still been due i.e. penatlies for not submitting returns etc. HMRC are allowed under current legislation to submit estimates for debt where returns were not submitted (not withstanding these are often massively overstated). In order to annul a Bankruptcy you not only have to proove what the debt with HMRC is but then clear that, plus statutory interest @ 8% + all costs of the Bankruptcy including the legal costs for the petition (usually £1500+) and the costs of the official receiver which assuming a private Insolvency Practitioner has not been appointed as Trustee in Bankruptcy will be anywhere upto £2,000, if a private IP is in place this could be significantly higher.

    Unfortunately the court take a narrow view of if you were treated fairly with regard to being at hearings, as long as HMRC complied with the variou protocols regarding service then its unlikely the court will overturn previous hearings on the grounds that you werent there.

    Does seem harsh in your case however the rules do unfortunately tend to play into the hands of the creditor, particularly where its HMRC with regard to estimated return debts, the onus is very much on you to proove the money isnt due if you hadnt sumbitted a return on time.

      Thanks for your information, surly as i deregistered from self employment in 1996 then i should not have been sent self assesment forms to file, also the benefits paid are below the threshold required by law to file returns.

        Thanks for everybody`s help in this matter, i think its just a case of "let battle commence" if i lose i do but this is morally and legally wrong in most if not all peoples opinion, i am in my latter years and this will hurt but i must try and fight so that the younger generation can stand a chance to get some sort of justice from the so called "system"

          just as a footnote to this case, it appears that in this country you can be totally innocent and have done everything as required by the revenue and the law and guess what you will end up in massive debt just to prove your correct and been correct all through even when the revenue have been informed before a case reaches any court....how good is that, makes you really trust the legal system........or perhaps i`m just nieve, but i may have information to help others in this situation, in my opinion i would not trust them as far as i could spit!!!!!!!

              I am told that i can claim all or a percentage of the costs back, but this is more than money its a principle and maybe, just maybe me fighting this may make it easier for others in the same boat as me.It seems the easy way out is to pay the creditors and the receiver off and fight the case after and reclaim the costs back from the revenue, however i have fought this for 9 years now and have lost all respect for the english legal system, further more i think this system "stinks", and fore sure the revenue will take there time paying back any costs and probably wont pay the interest accrued, and then we come to the loss of work, nights sleep lost, stress caused, but my partner seems to cope with me

                The problem seems to be, with the deeds of your property tied up in the system how does one raise the funds to pay off the debt and costs?

                  the bankruptcy time has expired now do they now have any claim on assets that have not been disposed of including any property
