    yeah thats right if it is indeed the debt i am speculating it could be, there still has been no Credit agreement or any other information submitted to me.

    i had to even go to the court to BUY the stat demand and petition and got the OR to send me the Bankruptsy Order,

    whats also wierd to me is the stat demand was sent to one court and then the petition was sent to another court?


    i really need to get it annulled, on the basis it should not have been served but strugglin with the docs

            I'm not sure you posts are getting missed. I just don't think that there are many people who have been in your position with a DCA making you bankrupt like this? I'm certainly following this (and you other threads).

            I'm glad to see that you are getting some help from 42man 'elsewhere'. He has had a DCA do this to him in similar circumstances.

            Please keep up updated.

            DCAs need to have these cases turned on them. Doing this without warming and abusing the insolvency procedures is not an acceptable way to pursue debts. They need to be shown that, and be made to pay a high price for doing so.

              I'm going to pm Cetelco about this thread, he is very good on set asides. I think he may have missed this thread.
              It is not that common for DCA's to do this so apologies if some of us are unable to offer better insight.

                thankyou Nibbler, it makes real sence what you are saying, i imagine its a very unusual situation im in. I just feel sooooo alone, every day is beginning to become a massive struggle, work is being severely affected i fear for my job, me and the missus arnt talking, its tearing us appart. really really need this to go away....

                  thanks Celestine, im getting scared now, really am i really need to fight them, i feel theres nowhere to turn.
                  Its effecting everything, Work have been good up to now and been rather understanding but the novelty is indeed wearing thin for them, im arguing with collegues im scared for my job. me and my missus arn't talking, im not spending the quaity tiime with my baby as i should, Im missing all her firsts, its killing me, im struggling to cope im struggling to be strong, i have no energy i cry constantly when im alone

                    i had a call from the OR the other day in regards to them makinmg me have an IPA, the thing is now my missus isnt working many hours, (only bring home £35 per week) she bearly pays for her car to get to work, the or wont take this into concideration she even said wek she can use your car when you get in... the thing is my missus leaves for work before i get in, she drops baby off at her aunties when she goes, and i pick her up on my way home.

                    The Or wont even allocate enough fuel to me to get to work. i spend 80 per week to get to work minimum pluss parking is 30 per month, they will only let me have 250 for fuel max.
                    she even said that she wished she hadnt let me keep my car as its now causing them problems.... (they know i only break even i have about 120 surplus) theyre just trying to make money even though i have nothing, out of order on my SOA.

                    It costs what it costs i work a long way from home. i cant believe this.
                    The OR is being really un reasonable.
                    they said because i cant agree my fuel they will do an IPO through court....

                    I need this to stop The OR is horrid really is and i feel like im being victimised, how can they do this to me

                      Sorry to hear that your OR is being unreasonable about the IPA and fuel.

                      Presumably you can produce receipts/records to justify your fuel spending? And that you have no other practical alternative?

                      If you can, then you can write to the OR with copies stating something like:

                      I have provided you with receipts/records to prove my reasonable and necessary expenditure on fuel.

                      Should you still consider applying for an IPO despite this proof of reasonable expenditure, then I will happily provide the same evidence to the court.
                      Maybe also require that the decision is reviewed by your examiners line manager? Usually an Assistant OR.

                      If what they are asking for or cutting out is really unreasonable, then it's not a disaster if they go to the court for an IPO. You just mustn't sign any IPA that isn't fair.

                      The OR will only very very rarely go for an IPO. Especially when they are arguably being unreasonable. It's very very embarrassing for them to go to court, only for a judge to tell them "not to be daft". I've seen it happen once.

                      The stats say it all. Last year the OR had abut 15,000 IPAs agreed, but the courts only allowed around 70 IPOs to be granted over the whole country. Shows that while an IPA may be threatened, the OR is usually very reluctant to actually go for one. And the courts don't hand them out readily either.
