  • Can someone help me. I have been made bankrupt

    I recieved a letter from the courts today stating I have been made bankrupt due to a debt owed to 1st financial credit (£8,000). I was issued a statuary demand a few months back, I thought the hearing was on the 10/11/09, but it was the day before. I very worried at what can happen to me, can I lose my house, goods, etc. I fell into financial difficuty last year, since then I have struggled with debt. However my situation has improved and I would like to start repaying back this debt. Can I get this reversed? I am so stressed at the moment, seems when I make a positive step forward something happens and take two steps back.

    Please help me.

    Do you mean you thought a set aside hearing was on the 10th November?

      Thank you for your response. I was served a Statutory demand a while back and then got a bankruptcy petition which I was to attend on 9/10/09, which I thought was 10/10/09. Due to my absence the judge declared me bankrupt.

      When the SD was sent I contacted 1st credit and tried to make an arrangement but this was refused. At that time I could not afford it, but now I can. Is it too late to change things? The company citifinancial are owed £7,937. I have asked advice but seem to be getting different answers can someone let me know where I stand. I just recieved a letter from the Official receiver today, can I lose my house and possession?

        Did you CCA 1st credit? I had a citi card, which was being pursued by 1st credit. Turns out they dont have a signed CCA and the debt is unenforceable, and they cant pursue me for the dosh.

        I dont know how you would do it, someone far more clever than me might advise, but you might try and overturn the decision to bankrupt you if you can prove there is no CCA?

        I just hope its not to late :doh:

          As far as I am aware you can appeal against a bankruptcy order in much the same way as you can appeal against any other county court judgement.

          You would obviously need to have grounds for appeal and would have to seek the Courts permission to appeal. I believe you normally have 21 days in which to do so.

          I will try to do a bit more research on this today and I am sure that Cetelco can offer some advice.

          What other conflicting advice have you been offered ?

          In the meantime could you please post up a copy of the bankruptcy order ( remove personal details first ) It should state something about your right to appeal on the order.

          Did you not do anything with regards to checking for unenforcable CCA on this debt? Also, do you have reason to believe that the alledged debt may be substantially comprised of charges ( for late payment or over limit transgressions )?

              You may apply for a reversal or annulment at any time provided that all your bankruptcy debts and all fees and expenses of the bankruptcy proceedings have been either paid in full or guaranteed to the satisfaction of the court. If you can repay the debts and fees, then you will need to apply to the court that issued the bankruptcy order. A hearing date will be set, which you must attend.
