  • Bankruptcy - pressing the button...

    Hey everyone,

First post and currently very nervous, anxious and worried.

I'm considering bankruptcy due to not being able to find the £ needed for my first income tax payment since I entered an IVA in 2022 due to endless ongoing issues with HMRC. If I don't make myself bankrupt, it's inevitable they will do so soon, I think...

My latest HMRC letter today says pay them, call them or they may visit. This is utterly terrifying but I also struggle massively with telephone calls - could or should I write to them?

My IVA includes a large HMRC debt prior to 2022 & since then I have accrued further tax debt.

Not to pile on excuses but I'm the sole earner in our home (self-employed sole trader) and we have 5 children including 1 with disabilities. The IVA was a stupid idiotic thing to do I know that but that's where I am now...and managing our household has left me with little spare.

I guess my main question is what happens? If I submit the bankruptcy petition there's no court etc but if I leave it to my IP or HMRC do I have to go to court?

I need to stop being scared and get this situation sorted out.

You need to get good debt advice from Citizens Advice or Stepchange. I am sorry to say that IVAs rarely benefit anyone except the sharks who peddle them.
