  • Bankruptcy & Bank Charges

    Hi

Does anyone know if bankruptcy affects reclaiming bank charges or if there are time rules for people reclaiming them? Cloudy area.

    Thanks a lot

As a bankrupt, the returned monies would have to be shared between the creditors.

If you are BR they are not yours to claim as such, they are technically an asset of your estate and any claims should be handled by the OR to reduce your overall debt in BR.
Once discharged they are still not yours to claim as they should have been declared to the OR at the time of BR as an asset and any attempt to reclaim them could be construed as concealing assets.
