  • Trust deed Scotland

Hi everyone, I have a question relating to a trust deed Scotland. My ex partner has entered into one and after setting up has sold his car and now has a significant lump sum which he hasn’t declared. I have contacted the trustee to no avail. According to him he has the money stashed away! Is there anything else I can do as it just doesn’t seem fair. Thank in advance

He has to make regular payments into the Trust, but anyone can set up a Trust Deed if they are pestered by creditors. If it was his car, then it gives him time to sort out his debts. This may be why you have not had a response from the Trustees.

You may be able to take him to court for a debt that he owes, but I understand that the Trust would still protect the money. A solicitor would be able to advise you in more detail, or the Citizens Advice.
