      Hi,

      It was sent via Royal Mail. Does that matter?

      I went to the court last week and submitted my application, I received the hearing date today - The last week of April.

      Do you think I've got a good chance of having it set aside? I'm hoping capquest wont turn up as I'm guessing that will annoy the Judge somewhat.

        UKMail is a bulk mailer that CQ use.

        Have you got the account in dispute with the bank over charges or at least SAR'd them ??

        if so it's all gravy.

          I've sent a letter to Halifax regarding the debt and the fact that I'm disputing it, I've yet to have a reply so if I don't get one within the next 7 days I'll send them a SAR and see where that gets me.
          The couple of months till the hearing affords me some breathing space to try and get somewhere with Halifax.

            All good.
            Obviously with the OFT's Test Case they wont pay out, but that is immaterial in this case.
            The fact it is disputed is important and makes a farce of CQ's SD attempts.

              I've received a letter from Capquest, along with: would you believe it an apology!

              They said they have been in touch with Halifax who say they have received no dispute from myself (which may be true as I sent the letter of dispute to Halifax a few days after my letter to Capquest, but either way the dispute is now formally lodged if they check again) but they will carry out further investigations and have requested my bank statements.
              They then go on to say that my account is now on hold and that the decision has been made to withdraw the stat demand. They then apologise for any inconvenience they may have caused.
              I've never had a letter as nice as that from a DCA!


              Am I right to still press ahead and attend the hearing in court to make doubly sure that this wont go through?
              Should I submit this letter as evidence in court? Hopefully I should be getting a reply from Halifax pretty soon too.

                You MUST attend the set aside and don't forget to claim your costs.
                This letter serves as excellent evidence of their abuse of process

                  I agree with Curly

                  Never ever accept a DCA's, particularly one like CapQuest, claims that they will not proceed with their present course of action. If they do & you complain they will sya there's been a breakdown in communication.

                  A number of DCA's try to lull debtors into a false sense of security & Cap Quest are one such organization. Anyway as Curly states you can apply for wasted costs so it won't be totally fruitless even if they do keep their word

                    Yeah righty, I was thinking that they might try some kind of trick. Either way it looks like they have shot themselves in the foot by sending this letter out. Once I've got a reply from Hailifax acknowledging the dispute then it looks like I'm sitting pretty.
                    Should I submit this letter and any reply from Halifax as evidence before or on the day of my hearing?
