I was over charged £1315.12 in excessive HC Bailiff fees. I have all the correspondance and calculations for this. The fee was paid on the 17th Nov 2009. Is it to late for me to re-claim this excessive fee?

I calculated all the payments to pay of the court award,and the correct Bailiff fees applying at the time from the Official fees allowed. The Bailiff has just added an additional fee of £1315.22 on, without any explanation of what they are for

Under what pretence are you saying it is a criminal offence? Presumably you are referring to the criminal fraud. Otherwise it's a civil claim where there is also fraudulent misrepresentation that has a time limit of 6 years of the cause of action.If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. I did look into claiming it back, but the solicitor I asked suggested it would cost almost that sum again in legal fees, and I wasn't in a situation where I could entertain that. I just seen suggestions that claiming it back can now be done much easier and virtually no cost. I came her to see if others had been down the same road. I did query at the time incidentaly, but my enquiry was ignored.

Unfortunately as other have said you are more than 6 years down the line and if you think fraud was committed then this should have been put before the Police to investigate. Proving fraud in these matters is very hard. VAT is chargeable on some HCEO Fees.

The 6 years time limit applies to debts. This isn't a debt in way or form. I've only just looked into this in more depth to have come across the criminal aspect. If I extracted money from a bank with the aid of false documentation, I'm sure after 6 years I could still be arrested and convicted of a crime.
