    Hello im looking for some advice,
    i had a fine of £270 from the dvla lastyear however couldnt afford to keep up repayments so it was passed to collectica, after their first letter i loaned the £270 and paid the court direct, this was the week before christmas, as i hadnt heard anything from the court or collectica, thought this matter was delt with. How wrong was i, today someone from the next street knocked on the door and said that someones wanted to speak to me, they had been knocking on her door accusing me of living in her property, at this point a man (who had been hiding behind my wall) stepped out and brandished his name badge, stating that although i had paid the fine in full i still owed £310 in fees, which i had to pay now or he would be phoning the police and a locksmith and removing £2000 of my goods, even though he or anyone else had ever been to my property before to establish what goods i had to sell, at this point i told him that i needed to make some phone calls and went to close my door, the bailiff then jammed his foot in the door using his body to push the door open, it all happend so quick i couldnt do anything to stop him, i screamed at him to get out of my house at this point my little girl was screamming please dont hurt my mummy and please dont take my mummy away, my dog was barking to which the bailiff said stop that dog or ill boot it in the head, at this point he was shouting at me telling me that hes in now and either i pay in full or he will remove goods this lasted around 10 mins, i told him that i was a single parent and didnt have £310 spare, so he started threating me with the police, and went to go into my living room, as my little girl was so distressed i decided that it was best to calm her down, i didnt feel like i had any choice and paid, lucky it is a bank holiday and my benefits were paid into my bank early or i wouldnt have had anything to give him. This whole incident although only lasted 30 mins has devestaed me, i have never felt so intimidated and frightend. Is this appropriate for a bailiff to behave in ths way and did he act within the limits of the law. Any advice would be fantastic.

        not necessarily ... they're often quite discreet

            If he did, his actions will have been recorded (meaning a complaint would be easier evidenced )

                  It is very hard to make an allegation against a bailiff (or anyone else that matter) without independent evidence.

                  A bailiff visit is never going to be a pleasant experience and very often, after the dust has settled, people become angry and launch complaints. I'm not saying the OP has done this but it happens all of the time. When it boils down to one persons word against anothers, it would be impossible to uphold the complaint. The bailiff will argue that he saw the open door as an implied right to enter-The OP will say he forced his way in. The added problem would be the bailiffs right to use reasonable force to enter. As the door was already open, the scenario would be at the point at which a locksmith had opened the door.

                  Was the person from the next street still present? Did they witness anything?

                  If you want to make something of it, perhaps a complaint in the first instance to Collectica? outline the facts as per post #1. Mention that you are a single mum on benefits and £310 is a totally unrealistic figure to take in one go without any advanced notice. Ask if a body cam was being worn. If so, ask that the footage be reviewed to colloberate your version. If no body cam was worn, ask why not?

                  Sorry-That's about the best I think you can do under the circumstances.

                    Hello thank you for your reply, my neighbour, who was comming home from work at the time witnessed the whole thing, until the point i told him i would pay then my neighbour went. also the woman from down the road has said that she is prepared to say what she saw, as she was the one who knocked on the door in the first place verifying that it was locked, she also said that while at her door the bailiff was aggressive towards her (sadly the woman had foung her mum who also lives at the same address dead that same morning) so was really in no fit state to be dealing with an aggressive confrontation.

                      Collectica don't use body worn cameras
                      None of the beliefs held by "Freemen on the land" have ever been supported by any judgments or verdicts in any criminal or civil court cases
