I've posted over in the VIP section but I've not had much feedback (maybe I've posted in the wrong place).

Can I just find out if the Fines Payment Office can send your account straight to Collectica without the 'Further Steps Notice' being sent out.

That wont happen the courts have a due process.
they will of course say they have sent it and unless proven otherwise it is deemed as sent.

if an arrangement is set after a further steps notice is issued and defaulted upon again, then they do not have to send another.

It is also quite possible in some circumstances that collectica may of done a credit trace search and found an alternative address and therefore letters may have gone to a previous address.

The Further Steps Notice is a final document form the court. If an appeal is not made within 10 wording days then a warrant will be issued.

If you have not received the FSN then you would need to contact the relevant Magistrate Court without delay. The problem that you may encounter is that HM Courts & Tribunal Service will likely argue that the document was deemed served under Section 7 of the Interpretation Act.

If you had moved address then the FSN would be sent to the address held on the courts records.

I've just spoke to the Fines Office and asked why they had not sent a 'Futher Steps Notice' before sending the acct to Collectica. They said they sent one on 19/12/14 and they did not need to send another within 3 months of the first. I told her that they had sent that out in error when they thought they were collecting the whole amount and we had to send a copy of our solicitors letter to prove that the court had arranged a weekly payment. I argued that my son had not had the 10 day opportunity to put things right and that he had paid the missed payments before he got the Collectica letter. I asked to speak to her manager who was adamant that they had followed the correct procedure and that we now had to deal with Collectica.

You need to find out the date on which the warrant has been issued to Collectica and the date of the Notice of Enforcement.

What date did your son make payment to the court?

Hi Milo, just got back from work.

Warrant date 10/3/15, Notice of Enforcement date 12/3/15. Received Notice of Enforcement 17/3/15.

Last Payment made before receiving Notice of Enforcement 13/3/15 but made another payment on 20/3/15 (thought they had made a mistake and better make his Friday payment),

Then got letter from Fines Office dated 17/3/15 (rec'd 21/3/15) to say acct had been passed to Collectica along with his last 2 payments from 6th & 13th Feb.

You say that the last payment was made before receiving the Notice of Enforcement on 13th March but that another payment was made on 20th March. By the time that this additional payment was made your son was in receipt of the Notice of Enforcement. It is a shame that he did not just pay the amount requested on the Notice of £75 as this would have avoided a visit and he would then be in a position to make a complaint to the court etc.

If you could list the dates that payments were made that would be helpful.

PS: A point that needs to be made is that when making payments to the court you need to allow up to 5 days for the payment to show on the account.

Can you provide the exact dates on which payments were made.
