I paid the 2.00 one yesterday so I could check my file as I only have a few agreements to my name which are all paid but this loan was red and the ccj section had no information in.

I was just getting on my feet as well.

Sounds like it is just a debt collector in that case, although if it were me I would double check the registry just to be on the safe side. Did they leave any paperwork ?

Debt collectors have no power to take anything all they can do is pester you.

No she gave them my new address which I've lived in since 2012 and vote so clearly they could find me via electrol register.

Hoping it was a debt collector as she's just trying to upset me by saying they coming to get my car. Shame I didn't get to buy anything with the loan to start with it was all for the ex and on his hobbies

It may not be her fault, debt collectors sometimes say, if she does not pay we may have to take her to court and then there may be bailiffs coming to take her belongings, only they either leave out or mumble the bit about the court.

Would you agree it's OK to wait for these people to contact her before doing anything @Milo??

I don't believe that she had much of a choice as the mother in law is not very forthcoming. A further problem is that the debt with Sainsbury's is showing as settled on her credit report and furthermore, a CCJ does not appear to have been issued against her.

She needs to keep a close eye on any correspondence coming through the post and return to the forum if she does receive letters from a bailiff.

Regarding the car, with it parked in a council owned car park, this would make it parked on private land not owned by the 'debtor' nor part of their premises, nor on a highway.

Makes it safe in my book.

So ended up having to facebook message my ex mother. She has said it was a debt collector.

But in her eyes just as bad, from what I have read there is a difference

Debt collectors are not bailiffs, they have no real 'powers' and can't actually take your belongings (according to Stepchange) all they can really do is hassle you

I've been sick with worry, but at least with my new address hopefully correspondence will come to me and with the expenditure sheet I've done they will except a payment plan.
