  • Ex mother-in-law had bailiff at her home looking for me

    In 2012 my and my ex parted ways after 8 years we had a joint loan that he said he would pay we have three children.

    I guess he stopped paying, my credit report says July 2012.

    Yesterday his mother called to say bailiff looking for my current address and that they are looking to take my car and property.

    My car was given to me from my grandparents along with a cherished plate for my birthday nothing new nothing fancy but I don't own my home and don't have anything of value.

    I am currently an unemployed single parent I dont have contact with my ex he was a very unwell and unstable man.

    My car is currently parked in a carpark the rear of my house this is owned by my local council. How easy is it to take my car I fear they could turn up and that would be that or take it while I'm at children's school. Where do I stand with the cherished plate?

    I can hardly afford basic needs let alone pay the loan my car Is funded by my grandparents and is a privilege that I cherish.

    1. Who was the loan with?
    2. What was the amount?
    3. Have you anything you can use to prove he agreed to pay off this loan?
    4. Have you had any direct contact with the bailiffs so far (letters/phone calls/visits etc...)?
    5. Your car is on HP/finance (not owned outright)? If so it should be safe from being taken - although it might be an idea to park it away from your property if you are worried about it


    There are certain steps that bailiffs and debt collectors have to take before they can even think about removing goods! If you can get an income & expenditure sheet sorted out, then you'll have something to prove what you can reasonably afford to repay weekly/monthly (if it comes to that).

    Please try not to worry ... there are lots of knowledgeable people here on LB who will be able to help/advise you, but they will need as much info as you can possibly give them in order to do this

          As the debt seems to relate to a loan then this should be covered under the Consumer Credit Act and private sector bailiffs would not normally be allowed to enforce such debts. You really do need to find out more detail about which bailiff firm. It could well be that the warrant is being enforced by a County Court bailiff. If so, this would be quite simple to resolve.

          Yes....at present your car is at risk. You need to find more details on who is enforcing the debt.

            Hi thanks for the response

            Car was purchased out right it is mine.

            Ex partner mother said they were looking for both of us but we don't know where he is.

            I have had no contact with bailiff I believe ex Mil gave my current address yesterday.

            Loan was 5000+ imagine it's increased now and was with sainsburys.

            I have no ccjs on my credit report. But this loan is down as Settled.

              I have no proof that he said he would pay loan it was coming out of my bank he then called and changed the details.

                Are you sure that this a a bailiff and not just a debt collector, There would have had to be a court case and a CCJ before the court bailiff could be instructed.

                  Ex Mother-in-law wasn't great at get details she was miffed that these people were at her door wanting to come in when I don't love there anymore.

                  I would imagine I will get correspondence soon if they have my address, just didn't know if they could turn up and take it there and then. As the loan is old.

                    Personally, I think you're fairly safe to wait for them to contact you. You'll find out who they are (bailiffs or dca's) and what they are willing to arrange etc...

                        As it debt is supposedly with Sainsbury's Bank then you are safe from private sector bailiffs in any event as they cannot enforce debts covered by the Consumer Credit Act. They debt would be enforced by a court bailiff and they are a lot easier to deal (and negotiate) with.

                            In the mean time I would check if there was a CCJ on this debt here http://www.trustonline.org.uk/

                            Sometimes a creditor will make the account as settled when it is sold to a debt collector, the the DCA updates the file in their name. I am guessing that is what has happened here.

                              I paid the 2.00 one yesterday so I could check my file as I only have a few agreements to my name which are all paid but this loan was red and the ccj section had no information in.

                              I was just getting on my feet as well.
