      If these fees are "extortionate" or "excessive" then you can claim them back in county court just like anything else; especially if you're forced to pay under duress. Which you were.

        I don't know if the fees are excessive, but £90 to come round after a mistake by the council seems excessive to me. They charged approx £100 for the 1st visit as well.
        Even though we asked twice verbally and once in writing to the head office, we still haven't received a copy of their fees / charges.
        Nat West 1 £9k settled AQ stage.
        Nat West 2 £126 settled LBA
        HSBC practice run £1330.00 settled on the Court doorstep....almost.

          They are only allowed to charge £24.50 for the first visit and £18 for the second visit and any subsequent visits they make, for the collection of unpaid council tax cannot be charged for at all.

          First visit fee (£24.50) is for a first attendance to levy, but where a levy does not take place. The bailiff can charge a levy fee if they levy, but cannot charge both amounts on the same occasion.

          Second visit fee (£18.00) Despite any further visits, the bailiff can only charge for a maximum of two visits at the fees for these visits are fixed by statute.

          Attendance fees must be "reasonable" and the Statutory Regulations state the following:

          "one attendance with a vehicle with a view to recovering goods after a levy has been made"

          The maximum number of removal/attending to remove/enforcement fees that a bailiff may charge is two. However for the second visit then goods must have actually been removed.

          Have you served them with a Subject Access Request under the Data Protection Act 1998?

          It seems to me that you have been overcharged, do not let them get away with this.

            A bailiff cant take goods for his fees once the liability order is paid in full.

            He has to take you to county court just like any other creditor to get his fees.

            He cant take anything from your dads house.

            I would have threw him out and if he had laughed at me he wouldnt have done it again.

            make a form 4 complaint to the courts.
            make a complaint to the council and remind them they are legally liable for the agents they employ and mention the 2006 fraud act. If bailiff commits an offence then they are liable.

            SAR the bailiff firm to justify costs.

            Hate bullys, I would have put him on the sick.

              If you have any sort of problems with bailiffs. I can help you as i am a self proclaimed specialist at dealing with them. I am hopefully going to start a degree (law) from october.
