Hi there im at my wits end here ,i originally owed £550 to my local council for council tax , they have passed it onto rossendales who have sent me numerous letters and visited my home twice as far as im aware , i met the bailif when i answered my door for the 1st time on tues (yesterday) he handed me a letter saying they were coming to remove goods from my home or recieve full payment on fri in 2 days time they have not ever entered or been invited into my property i stated when i spoke to him i could not pay in full and could we not come to an arrangement he said no . The debt is now £850 , i have managed to get £500 together and telephoned the recovery dept at my council and let them know i had £500 and could come down today and pay it to them , they refused to accept payment and told me to phone bailifs and pay them the £500 , (i have not done that though) i telephoned a council tax advisory service who have said i should consolodate my debts and pay it over 5 years , i really only have a problem with this council tax debt and do have the cash to pay the original debt , i dont know weather i should take the advisory service advice and consolodate debts/loans i have now as all my loans etc are up to date . Could someone please advise me on what i should be doing please as i havent got a clue . I can pay the full £550 at any time now

Bailiffs coming to remove goods in 2 days is there anything i can do

My suggestion would be, pay it direct into the councils bank account, then fight over the fees, There account details are usually o the back of the council tax bill.. I personally despise rosendales
post up the full dates, CT period, when the Liability order was gained. and dates of any lettersa you have had from them.... am not up to date on the new baillifgs regs, but if you post the details, someone else will advise on if they can remove goods that fast, or there just trying it on.crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

Hi and a big welcome to LB. Hopefully between us we'll be able to give you some help.
When was this debt passed to Rossendales for enforcement?
Do you know:
1 - how many Liability Orders they have against you
2 - the dates they were obtained
3 - the addresses they were for
4 - the period of time each covers
5 - how much each one was for
6 - how much is still outstanding
7 - the dates they were passed on for enforcement
8 - the dates & amounts of any payments
If not, you need to speak to someone at the Council and get the answers.
I think there's a muddle over charges, but we can address that when we have answers to the questions above. Personally, if you can afford to pay the debt now, I can see no point in paying interest on it over the next five years when it could be cleared and done with. It is unusual advice - which company gave it to you?
Are you positive the current figure given is £850?
EDIT:
I see I've crossed posts with Crazy Council. It is because of the new regulations I'm NOT suggesting you pay it directly to the council just yet. Hold fire for the moment, don't let any bailiff into your house and keep your car parked a few streets away so they can't 'levy' (to use the old language) on that.

the ct period was ;last years although i think i may need to find out the dates as i gained my 1st job in 20 years last year and came off benifits ,i will contact the council tomorrow and pay the amount in full ,then ask when the liability order was granted to rossendales, ive had 3 letters as far as im aware however i have been ignorant to the fact until now admitidly (stupidly hoping it would all go away) i have only had one letter handed to me personally which was the one i recoeved yesterday and which i have immediatly acted upon and realised this is not a matter to ignore.Could you please advise me on how i can gain any information i need.

There is no right or wrong way to deal with debt-It is what works best for you. A couple of points regarding Rossendales:
Firstly, they may not come when they tell you that they're going to. You need to be on your guard for them. You do not have to let them in & should not, under any circumstances do so. By letting them in, you could expose yourself to further fees and also put Rossendales in a very strong position regarding negotiating repayments.
Secondly, you need to find out when these visits have taken place. If any were before April 6th, their fees will be a little less than they're asking. You should contact Rossendales in writing asking for a breakdown of fees and the dates any visits took place.
Regarding the debt, PROVIDED you don't let the bailiff (EA) in, he cannot take any of your goods and has no power to tell you what you have to pay. You should try phoning him, tell him you're not letting him in & you won't be entering into an agreement with him. You then tell him what you will be paying & he can take it or leave it.
If it was me, I would be inclined to put the £500 into a building society account and offer to pay £100 a month for 8 weeks. That way, you are covering yourself if there is ever a time when you can't pay (you just dip into the account)
If you have a car, this will change things as he can get hold of this quite easily if its on your drive. You should hide this away, a good 5 mins away from home.

If I were you I would check the debt is correct before paying. If you were on benefits last year, was this during the period concerned here and if so, were you entitled to a reduction in your CT?
It is your decision, but I wouldn't pay anything more than I know is correct.
I would follow post 4 and ask both the council and Rossendales for a breakdown of fees.

I agree there is no right or wrong way but it's the next few words I have an issue with "to deal with (the) debt".
Depending on the answers to some questions, we have not yet established how much the debt is. IMO it is sensible to establish the correct level of debt before paying 'an amount' which may or quite likely may not be correct. :beagle:

The problem that we have here is that enforcement action is ongoing.
This is why I suggested payments of £100 per month-It gives the debtor 6 months to get the full facts and in that time, the debtor would have only paid off the council tax part of the debt. In reality, all the information would probably be gleaned in less than 2 months. I don't think theres much dispute that around £500 worth of tax is owed, the issue is more to do with protecting the debtor from unfair charges and unfair re-payment plans (which could in turn lead to unfair charges)
As the EA has visited, it would be safe to assume that an enforcement fee of £235 can be added to the bill.
There would be no harm in beginning to pay this off in monthly instalments and would look far better than simply refusing to pay anything for the next 6 weeks or so until all relevant info is at hand. The beauty is that the debtor has £500 to play with so in theory, after 3 monthly payments, the debt could then be paid off in full. It would be a mistake to pay £500 directly to the council at this stage though as it will not change Rossendales stance whatsoever.
