  • Rossendales bailiffs

    I got int arrears with my council tax and a court order was issued for the collection of payments.
    arrangements were made with Rossendales for the payments at £50 per week.
    On Wednesday 11th June 2014 I received a letter in the post from Rossendales saying that I was in arrears to the amount of £100.29.
    Due to the shifts that I work I didn't get home and read my mail untill 05.00am on Thursday morning.
    I went online to Rossendales web site to make the full payment via there online payment site. A message appeared saying that the online facility was not working and advised me to use the phone payment line.
    At 06.58 on Thursday I made the payment on the phone payment line for the full outstanding balance and revived a payment reference number.
    Just after 09.00 I received a phone call from a Rossendales bailiff saying that he had call at my address to remove goods to the value of the outstanding amount.
    I explained that I had made the payment in full to clear the debt and he said that because he had called at my address to remove goods that there Was now a extra fee of £130.00 which must be paid or he would return at 12.00 noon to remove my car and further charges would apply.
    i gave him the payment ref number and he said that it takes over 24 hrs for the payment To be marked against my account.
    I felt I had no choice other than to pay his charges.
    I phoned Rossendales office who were very un helpful saying it was out of there hands and I must speak with the bailiff.
    how do I stand and can I get this extra charge returned.

      Looks like the bailiff/EA rely on the Cleared Funds argument. That the payment needs x days to show as cash in the acccount. This one needs kicking into touch by HMG as these days a payment by Debit Card is virtually instantaneous.

      Where does he gat the £130 from I wonder, are Rossendales using their own interpretation of the rules, again?

        If the visit took place after the payment, you owe them nothing. It was the EA's job to ensure ALL his information was up to date before visiting your property, he clearly did not do this which is not your problem.

          Pete_h needs to send a Formal Complaint to the council possibly stating debt paid a day or so before the EA fetched up, but as he is be aware DossendaLes will claim that the payment is NOT cleared funds and carry on regardless, so a Formal Complaint to council CEO and copied to dossendales is an option.

            Bearing in mind the requirement for 7 clear days to pass before enforcement commences, the date of the letter received on 11th June is critical.

            We also need to understand where the EA has got £130 from. It could well be that a compliance stage fee of £75 is payable but if he visited, the correct fee would be a further £235. A breakdown of charges from Rossendales is required.

              Was this letter headed Notice of Enforcement?

              Did it give a time and date by which the £100.29 must be paid?

                My apologies-I didn't read the first bit of post #1 properly.

                Just to add to Wombats questions, we need to know what fees have been charged previously and if the OP signed any paperwork.

                It looks to me like goods have been previously levied upon (the car) which ties the debt to the old regulations & more importantly, old fees.
