In your post number 9 you said to tell the High Court enforcement office. I'm not sure where to start if it isnt illegal to have an open office Im also not sure if I can make a compliant or should my brother contact them as its him there after? Do they have to have an office registered with the High Court?

I would certainly make your concerns known to the High Court and follow Ploddertom's advice in Post #8.

OK, I'll get my brother to post them a letter for what its worth.

A question on the debt - will he have to pay the £90 baliff letter fee once a payment plan is sorted by the court?

In my opinion if they have got the Notice of Enforcement wrong then it is non-compliant and the fee is not chargeable.

They will no doubt stamp their feet and throw their toys out of the pram but if they cannot follow what appears to be simple instructions for the new regulations then they should go back to school and find out how to do it properly. One would expect companies like this to set a better example.

As for their lack of contact details I would make a complaint to the Chairman of the High Court Enforcement Officers Association martin.leyshon@hceoa.org.uk .

I'll post back with any developments.
