    Hello, I was searching some help in internet to resolve my bailiff problem and came across this great forum. I apologies if similar case is discussed before but I couldn't find anything with same circumstances.

    Well, on 30.05.14 while I was painting a client's house in Forest Gate I saw a man putting a wheel clamp onto my car. Immediately went out and asked him why he's putting the clamp. He said he works for JBW and that's a cold case from Barking and Dagenham. I wanted more details about the case but the man just informed me that conviction happened on 18.06.13. He suggested me to phone the number in the notice onto my window. I spoke to some man and said that I never have received any letter from that council or from JBW. I asked how to appeal against their action but he said there's no way out of that situation so if I don't pay they'll get my car. I was completely shocked and paid £512 fine straight away. I'll upload everything I have been given. I couldn't work after all and tried to understand why is this happening.
    On 19.06.13 I moved from address A in Newham to new address B in Newham as well (could prove that by tenancy agreement) where I lived till 25.11.13. I checked the receipt which I have for that payment and there is address B but in the JBW van that man showed me my previous address A. At this time I live at address C. I am 100% sure that till 25.11.13 I haven't received any letters from Barking and Dagenham Council as well as anything from JBW. My fault was that when I moved to my current address C, I totally forgot to amend my details in DVLA until the middle of April 2014 when I realised my car insurance would be due in the next few weeks. I received my new V5C logbook in early May. Sorry if the story is too long but I don't wanna miss any important detail.
    Well, on the next morning Saturday 31.05.14 I was just preparing for work when my wife saw my car clamped again. This time my car was parked in front of my house on the street. I didn't get stressed about that because I thought that's just mistake probably because of late updating of JBW system. Anyhow I called the number on the sticker onto my window and spoke to some man again. I told him I paid yesterday £512 fine for PCN to JBW but when I told him the ref nuimber he said this is different PCN from Newham council and he works for Newlyn bailiff. The date of conviction was 7.08.13 and then I told him same thing that I never have received a letter for this fine. I told him that I'm not sure if I would pay the money because I don't think is my fault this situation but he said that if I don't pay he'll send a truck to get my car. Half an hour later he phoned me and said he's outside my house. I haven't been given any other option but to pay the money straight away, so I have paid another £512. On that receipt appeared my old address B, but the man came to my current address C. I'm sure JBW sent Newlyn a note that they got my £512 and Newlyn probably checked my details in DVLA and came at my address same evening (18:48) when I was at home watching TV. They obviously didn't knock at my door neither left a letter in the postbox but clamped my car. Aww I nearly missed that Newlyn worker told me 4 letters have been sent to address B but didn't mention when that happened. I really never have received any letters from Barking and Dagenham, Newham council or JBW and Newlyn on address B till 25.11.13. Since that time my wife was there to check for any mail and she collected some letters but there were no penalties or something like that. I have never paid a PCN at the full amount because I always pay before 14 days term. I supposed all of this is because I exchanged my V5C logbook very late when I moved to my current address C in Ilford. Then I searched online similar to mine cases. According to my knowledge bailiff should reissue Warrant of execution once they find that debtor changed his address otherwise they can't clamp my car. I don't know if this is right but that's why I posted my story here and would appreciate. My situation is very bad anyway because I found that I have another 4 PCN's raised to £650 for parking on "Loading only" bay but that's another story which I'll post in the proper section. Could you suggest what I could do after all. Could I get refund of bailiff charges , because I would pay them straight away if I only knew about them. I was wondering if I can even appeal against the fine because I haven't received any letter from council or bailiff company.

      Your query is actually VERY serious indeed for many reasons.

      Firstly, your experience reinforces my belief that ANPR for the enforcement of unpaid parking charge notices should be BANNED.

      It would seem that one thing that Newlyn have done right is to complete the forms.

      When your vehicle was clamped by the JBW bailiffs were you provide with the same form?

      Was a breakdown of fees provided?

      I cannot see the name of the JBW bailiff.

      This morning can you please contact the Traffic Enforcement Centre and ask the to CONFIRM the precise address on BOTH warrants. If the warrants have your current address ask the operator for the DATE that each local authority applied for permission to re-seal the warrants.

      You MUST ask the operator the date that both warrants were authorised. This is vitally important.

      With regards to the others tickets that you have can you post back to let us know whether these others are at 'warrant' stage or Order for Recovery (or Charge Certificate stage). If at warrant stage it is a simple matter of filing an Out of Time witness statement for each PCN. I can provide further info when you post back.

        It is my understanding, Milo, that a review of the use of ANPR by those other than bona fide law enforcement agencies is planned. Initial rumblings in the jungle are that local authorities will be banned from using it. It would not, therefore, surprise me if civil enforcement companies and private parking companies are included in the ban. The general consensus appears to be that its use has been abused.

          Hello, I really appreciate your help. JBW have given me just receipt. When I paid by debit card I went back in the house and left the man to remove the clamp. I was pissed off and didn't want to stay there and possibly to say something which I don't mean. So the man removed the clamp but after that removed the note sticker onto the driver's door window. On that note was just standard message that my car is clamped and were provided two mobile numbers for further info but nothing else. I'll call TEC today and will ask them about this information. This evening I'll post what happened there. Kind Regards

            Al the things happen with you is not so good but also not so bad. This is happens for a reason. Presently i have no idea given to you but the idea or opinion given by other members is good so you should choose any one person opinion and use it.

                Hello everyone. Today I called Traffic Enforcement Centre. I asked them for confirmation of address of Warrant. they confirmed my previous address to both of the PCN's. I live in Ilford, London, but my previous address was in Romford Road, Manor Park, London so they confirmed that this is the address on both of that Warrants. They have been issued originally to my address (Katherine Road, East Ham, London) where I lived before I move to Manor Park. The funny thing is that both of the Warrants are re-issued 2014. JBW re-issued my address on 09.01.14 and Newlyn have done same thing but on 27.03.14. I am 100% sure that before 08.2013 I have updated my address in DVLA from East Ham, London to Manor Park, London. I know that because I received my tax reminder as well as the tax disc through the post which happened in August 2013. So according to my knowledge if I get penalty, in my case both are £130 each (if I pay within 14 days is £65, if not would be £130, after that if I dont pay within the 28 day perioud would rise to 195 and then after another 28 days would be 202 because of court fees = 56 days). At the time when 56 day perioud was expired for both PCN's my address was updated in DVLA and it was Romford Road, Manor Park, London. I wonder if bailiff company should check with DVLA the current address of debtor before they ask for Warrant of execution in the court. The other thing is if the address of Warrant and the real address of the debtor doesn't match, should I sent Statutory Declaration? Much appreciate your help guys!

                  Let's get this straight. Are you saying warrants with your previous address on them were executed at your current address and the local authorities and civil enforcement companies involved have not applied to TEC to have the addresses changed on the warrants before executing them?

                  I do know that any warrant - civil or criminal - must be executed in accordance with the conditions endorsed thereon. If the person executing a warrant does not comply with the conditions to the letter, this can have the effect of rendering the warrant invalid and their actions unlawful or, possibly, illegal.

                  Let Milo advise you further about this matter, but from what you have said in Post #8, there may be issues relating to the actions of the civil enforcement companies involved and the failure of the local authorities involved to have the address on the warrants changed.

                    The address they are given by the DVLA is that that was in existence on the day the contravention occurred.

                      Agreed, PT. However, it is my understanding that if a civil enforcement company subsequently discovers the debtor named on a warrant has moved address, they are supposed to notify the creditor who, in the case of PCNs, is then required to notify TEC and seek authority to reissue the warrant with the new address endorsed thereon.
