If the police have admitted your vehicle should not have been stopped and seized, then they should take steps to retrieve it from Newlyns' clutches.

What exactly have Newlyns legal people said? I could do with a good laugh and may be able to draft a suitable response for you.

Chris Royle of Exchange Chambers in Leeds is very good, he is clerked by Ian Spencer.

chris is good on bailiff stuff but im not sure if he is direct access.

Problem with that is he'll want someone decent so would need to find one then do a lot of research and he'd still probably be worse of than getting a recommendation.

Re: Anybody know a good barrister ready to go to court

Christopher Royle? This wouldn't be the arrogant idiot who was invited by HHJ (I am wholly unfamiliar with the structure of the law regarding traffic penalty enforcement’,) Holman to talk him through the that procedure which Royle knew nothing about but who gladly took up the offer anyway.

As a result these modern day clones of Laurel & Hardy convinced themselves that CPR 75.4 allowed a local authority to send electronic authorisation of 'warrants' to bailiffs which the equally ignorant MoJ still believes today

A month later Lord McNally answering an official question from Lord Lucas in the Hourse of Lords confirmed that 'bailiffs are not applicants to the proceedings' ie the proceedings being CPR 75.

If it is the same imbecile, then beware that a man who was once convinced that bailiffs can print 'warrants' may not be the best choice in protecting the public from such abuse.

                  Sweeneyblue,

Would it be possible for you to scan and post up the letter from Newylns' "Legal Team", removing any personal details first, please? From what you are saying, it sounds like Newlyns are trying to bail out a boat that is rapidly sinking.

This would be the Chris Royle whom I have instructed on a number of occasions and who todate has never once let me down and has achieved a number of superb outcomes for my clients.

I think before slurring a barrister, perhaps producing the transcript of the hearing would be preferable?

Re: Anybody know a good barrister ready to go to court

                      Why?

I have told you what happened. On what basis do you think I am mistaken, given that I attended and you did not?

If you want to purchase the transcript then feel free to go ahead. You could include a request for a transcript of the hearing at Brighton County Court two weeks earlier wherein he repeated the same error.

Whether he has never let you down or not has no relevance to his performance over parking on these two occasions. His knowledge in parking enforcement is severely lacking and worse he has promoted an untruth which some may believe resulted in two miscarriages of justice.

If he believes what he did three years is still correct, then he is a danger to anybody who needs relief from bailiff companies, especially those companies which print their own warrants and pass them off as 'genuine'. The Christopher Royle I knew had no idea.

Id be very surprised to see Chris Royle on a bailiff job in Brighton!!! hes based in LEEDS and he was difficult enough to get to come to Derby for a hearing, so perhaps your not talking about the barrister im on about.

I think it is the same person (LINK) . I've read only one side of an argument however, so it would not be appropriate for me to comment further in this post.

Having looked at his website I can confirm that it is the same barrister and he was most certainly in Brighton County Court on 8th June 2011 representing Mid Sussex Council

Ah. Mid Sussex District Council. Well-known for obtaining Council Tax Liability Orders against people who don't owe CT and then lying publicly that such a person was in arrears with their CT when it comes out in court that they acted unlawfully by seeking a Liability Order, as they did in the case of R -v- Tucker [2012]. Not content with being slammed by the most senior circuit judge on the South Eastern Criminal Circuit, along with Sussex Police and the CPS, twelve months later they did the same thing and are now having action taken pursued them. I would say that any legal professional who accepts instruction from Mid Sussex District Council should ask themselves the question, "Is it worth risking my reputation as a legal professional representing these muppets when they have a history of balls-ups?"
