    Hi,
    Hopefully someone can help out, had some debt problems recently. Got a liability order from the Council for unpaid Council Tax a few months ago I agreed a payment settlement with them but they changed it after a few months and have now sent my details to Newlyn.
    They have charged me £75 for a letter and I contacted them for a payment plan they refused and said the debt needs to be paid today in full, ask family for money I have no family to ask for money so I said I cannot pay so send someone round.
    The other problem is if I dont pay by Monday they add another £250 to the bill for sending someone round, is this right?
    Not sure what to do if I get the money together (thats a big if) do I just pay the council direct with the initial debt and forget Newlyn?
    Or will they pursue me for the £75 letter! and the add ons like the £250 after Monday?
    Thought Newlyn would let me pay monthly or something but the person at the other end was quite rude and told me to get the money from family by 4pm today!
    Any help would be appreciated.

    Write a formal complaint to the CEO of the council. Copy Newlyn in on the letter. Try to send a copy via email as well to ensure it arrives asap.

    Outline the situation exactly as you have done in your post. Advise that Newlyn have refused to allow you to enter into a payment plan and if you don't pay in full, they are going to attend your property and charge further fees. This is a totally unreasonable burden to place upon a genuine debtor who is attempting to deal with their debt. Quote section 4.4 of the Guidance to Local Councils on Good Practice in the Collection of Council Tax Arrears, published by the Department for Communities and Local Government:

    4.4 Arrangements should seek to safeguard against bailiffs entering into punitive
    repayment arrangements directly with bill payers. Local Authorities should consider
    how they manage their relationships with bailiffs to have oversight over such
    arrangements and set parameters for such agreements. They should be mindful of
    the impact that repeat visits may have.

        Good advice from SP, but also copy the Council Elected Leader (political) and yor local council member and MP into the letter of Formal Complaint, that way they can see that the new Regulations on Taking control of Goods are being misconstrued already, as that refusal to make an arrangement affordable to the debtor is a bit naughty.
