  • JBW Extra Bailiff Charges

    I got a Notice of Enforcement letter dated 07 04 2014 with a £75 Fee. i phoned the bailiff to try to make an arrangement to pay over 3 months, which they refused i am suffering hardship at the moment but recognise i do have to pay the PCN i explained to her i could not afford to pay the whole amount at once £277.00 but she still refused, i said i would contact them in writing with my offer to pay. Days later got a letter saying i owed another £235.00 i phoned then again and they said they had not received my letter i borrowed the money and paid the £277.00 but they are still pursuing me for the extra £235.00 on their website the say they accept arrangements from betwwen 3-6 months i have had to borrow more and have got myself into further debt and cannot afford the additional costs I contacted the council and they say the debt has been payed in full and they cannot help. i also see that new laws apply to bailiff fees from 6 4 2014 and the council instructed JBW on the 3 04 2014.

    Hello Tank1 and welcome to the forum.

    When you wrote to the bailiff in the first instance did you send the letter recorded delivery?

    If you did then you can find out when and who signed for the letter, if it was within the period stated on the bailiff first letter then you have enough grounds to write to them again and question the extra £235.00, do not forget to mention their statement on the web site about the 3-6 months for a payment arrangement which is what you were aiming first.

    Depending on what the outcome of this is, and the bailiff company insists that the £235.00 is still due then you could tryt to pay that over 6 months.

      You could try a Formal Complaint to the council CEO, copied to the elected leader, and your MP stating that they refuserd a reasonable offer of payment regarding your circumstances, and further you felt obliged to borrow the money therefore taking on extra debt. JBW are another of those companies that should be closed down l

      What was the DATE on the letter you had from Jamies Blithering Winkers? on 14/04/14? This will be important as if it was dated more than 2 days before, it might be argued in the complaint that you ghad insufficiennt tiome to pay the debt. However if the contact with an offer to pay was within 7 days of the date and they refused.

      It may be argued they are using the 7 day period stated in the letter creatively to make sure no one can discharge a debt within the 7 days so they can apply the £235 Enforcement fee.
