  • Bailiffs Fees Advice please..

    Hello everyone,

    There is more to this tale however on this thread please may I have some advice on fees...

    I received an enforcement order for a PCN for £110 from a bailiff agency. At this point I filed an Out Of Time report which came back refused. In the refusal letter from the courts it states "The response from the local authority with regards to your out of time application should have already been served to you" It hadn't but I had to go away for 4 weeks. I only mention this as it is the reason for not appealing the OOT decision - I would need to have all the information to hand to do this inc the letter form the council. Today however I find out in an email from the council that they had told the courts they would not be sending this letter to me. How was I to know this??

    On returning from being away I find a Warrant of Execution from the bailiffs for £420. For right or wrong I paid the £110 to the bailiffs. I then emailed and sent a letter (with proof of postage) to the bailiffs asking for a breakdown of their fees. I heard nothing back.

    I write to the council explaining everything and in the meantime I then receive a notice of intended seizure of goods for £223

    In the same letter from the council today he says that he had been in touch with the bailiffs and they claim to have received neither letter or email regarding my breakdown of fees request. He asked them himself for a breakdown of fees and has sent it to me.

    My main issues are -

    Why are there differing amounts on the letters? Take the 110 that I paid from 420 and you are not left with 223.
    I have been advised that the warrant of execution is not legal as it is not from the courts?
    I have never seen or spoken to the bailiff and have signed nothing. The 3 letters attached are the only paperwork I have had so am I right in thinking they can not charge a levy and attendance fee as nothing has been levied?

    I see that the original letter from Collect is dated October 2013, and that the second (handwritten letter) is dated January 2014.

    May I ask why you did not pay on the first letter?

    However, the amount of £420.34 on the second letter is quite wrong, whilst the third letter and the breakdown of fees is correct.

    As far as the legality of a warrant of execution, whoever told you it is not deserves their brain retuning, as it is issued by the Northampton County Court section that deals with all the PCNs in England and Wales.

    The charges are for attendance to levy, not for effecting the levy, if levy would have been done then there would be further charges to pay, around the £240 mark, plus the ongoing cost of a walking possession.

    As far as sending important mail with only "proof of postage" is somewhat reckless, always use signed for, that way you can turn around and state that such and such a person of your firm signed for it on such a day at this hour.

    It still beats me you did not pay for it in October.

      Hi thank you for your message. As I said there is more behind the story in that the first I knew about the ticket was when the first letter arrived. In between that and the second letter I filed an out of time which came back refused and whilst waiting for a letter from the council, which I was told on the letter from the courts would be arriving, the second bailiff letter arrived. I didn't appeal as I was waiting for this letter from the council to see what next before I did anything.

        Also the only address given was a PO Box and I wasn't aware you could do signed for on a PO Box?
