  • Bristow - Sutor PROBLEMS

    Hi

    Im currently having trouble with the above debt collection company..
    It all started when i sold an Audi A3 car in Aug 2012.. the guy i sold it was a car trader and he said he would send off the V5 to save me trouble and i didnt think any more of it..
    I moved house 2 months later and never got around to changing my address with the DVLA (you can see where this is going)

    Well i got pulled over in May last year and the officer advised me i had been banned from driving for 6 months due to not responding to 6 speeding tickets issued in Loughborough, So i chased it all up and it turns out the guy i sold the car to had never re-registered it with his details for the new owner.. So i went to court and did a statutory declaration to say i had not owned the car since 2012 and knew nothing of these, and got the ban and points removed from my licence.. And didnt think anything of it

    UNTIL

    I came home from work about 4 weeks ago to 2 letters from from Bristow-Sutor advising me i owed £629-88 for one ticket and £418-50 for another ticket,
    I rang them and told them i had done a stat dec with wakefield magistrates court to say this wasnt my issue any more and they just demanded i pay asap, so tried to get to the bottom of it and had no luck.
    And today i came home to more added on one the fines a £235 for a enddorsment fee

    Can any1 advise me what to do?
    Who to speak to?

    Iv called the DVLA and the car is now no longer in my name, I have the other guys details from the V5 i took a pic of, and i have the original receipt he signed, but i just cant get anywhere with removing these debts from my name,

    Can you prove that money changed hands at the time of the sale? ie cheque etc?

    Can you get hold of a copy of the paper/magazine in which you advertised the sale of the vehicle?

    Do you have evidence (insurance, V05, sales receipts, money transactions etc) that you purchased another vehicle after you sold the Audi?

      Hi mate.
      Yeah i have got a pic of the V5 and i have got a pic of the receipt, but nothing else..

      I have already proved to one court I had sold the vehicle at the time the issues arose, and it didnt belong to me at the time of the offences

      I just want to know who to talk to..

      How much are Bristow- Sutor legally allowed to charge for a vist? Does ahyone have there bill break down?
      I knew Rossendales were only legally allowed to charge £42.50 and not a penny more, so wouldnt mind knowing what these morons are allowed

        Ok try in the first instance to write to B&S, explaining the situation as you've posted it on here. B&S are sure to ask you the type of question that I've asked you, so the more that you can give them, the easier this will be to resolve. Add that you have a pic of the V5 & a pic of the receipt. If you have the other parties full name & address then pass that onto them as well. Try to dig out anything else that might help convince them that the car was sold. Ask in your letter what court issued these fines, is there a court in Loughborough or is Leicester the nearest one?

        The Rossendales fees appear to be for Council Tax. All fees are the same now and the correct fee is £235 for a visit.

        If you can keep your car away from your house while this is being resolved, it would help. Preferably a good 5 mins away & on a friends drive. The only way B&S can add to their fees now is to get hold of your car (unless you let them into your house which I presume you won't do?)

          If it is B&S then it isn't for speeding tickets that you have already dealt with. More likely to be unpaid Parking Tickets which again have probably been incurred by this other person. If so it is a slightly different process - Traffic Enforcement Center - but if you have a copy of your previous Stat Dec then that will help reinforce your case.

            I thought it was a bit suss when the OP said B & S were chasing speeding fines. They don't have a contract with HMCTS.

                When you contacted DVLA, was it by phone or email? If by email and you still have the email from DVLA confirming the vehicle is no longer in your name, print off copies, one each for the local authority/ies involved and B & S and send to them by Recorded Delivery. You may also have to contact the Traffic Enforcement Centre at Northampton and explain the situation to them. Basically, the charge certificates needs to be cancelled on the "warrants" relating to the PCNs. Strictly speaking, you cannot be pursued for something you have not done or are not liable for.

                  I know i cannot be pursed but I am, because they are stating that i was the registered car owner at the time of the offence, this is really starting to grind me down now!

                    Have you contacted the Traffic E nforcement Centre as that is where the Warrants were issued? Explain what has happened and you have proof via your previous Stat Dec. They should be able to email you the forms you need to fill in, you email them back and everything comes to a halt while the info is looked at and a decision made - can take up to 8 weeks.
