I have a DWP Tribunal date in 4 weeks regarding alleged "undeclared" income I'm disputing as it wasn't income but payment in kinds. My IS account has been put on hold and no further action will be taken until the Tribunal has come to a decision. The Council has turned around and claimed I have been overpaid as this alleged "income" meant I wasn't entitled to IS and hence not to HB and CT. To cut a long story short, the Council has refused to put my account on hold until the Tribunal and has today sent the Bailiff who left a note saying he'll be back on Wed at 6 AM to remove goods. Apart from the fact that this is not my house and I don't own a car nor any of the furniture, T.V, etc., I wasn't going to let them in anyway but what can I do to have my account put on hold? Ask a solicitor to write a letter? ANy input is appreciated.

Re: Council Tax Dispute - Bailiff sent - how to go about it?
Council Tax and they have sent me a piece of paper saying Liability Order but it's been written by the Council - not the court. When I inquired regarding the actual Liability Order, they got nasty and told me that piece of paper was the order. When I queried it further, I was told the actual order was at the Council Offices and could be viewed by me but they refused to send me a copy. Is that legal?

If they have a Liability Order then they are doing nothing wrong. You should ask them when it was granted and for how much. Were you advised it was going to Court? After the LO was obtained did they advise they were going to seek enforcement?
If the answer to those 2 questions is no have you moved from the property the Council Tax was against and if so did you notify them you were moving? I wouldn't get too hung up because the Council are saying they have a LO and not the Court as this is usual practice in that they are done in bulk.

I have since moved yes and they have my new address. My point is, though, that everybody else has put accounts on hold until the Tribunal at the end of April and only the Council is being awkward. They have also taken me to court saying I allegedly failed to notify them that I had additional income to which I pleaded not guilty. The hearing has been adjourned. To get back to the main point, I'm not going to let the bailiff in and I'm not going to pay them. It's Excel by the way. Is there anything I can do today to stop them from coming out at 6 am tomorrow morning? We live in a very rural location and they have to travel for at least an hour to get here.

There is no law that says you have to speak to or deal with a Bailiff. If they have to travel for an hour to get to you that's their problem. No one asked them to do that. Whatever happens do not let them in - a seriously bad idea. They'll no doubt threaten all sorts but that's all it is, they are all moth and no action.Originally posted by Ilovetherockies View Post------------------------------------------------------------------------------------------
