Hi I'm going to cut a long story short just need to know how to deal with the above people Bristow Sutor with council tax arrears. Letter today is New Enforcement process commenced. They have visited to house twice but not answered hense why we have this letter. Hubby used to pay as attachment of earning to council I believe but changed job last year and forgot all about it. we owe two years sum of 1262.59 + 1297.91. letter basically say about the 2 orders, bailiffs and the process es they use and fees will change on 6th April and the letter is to inform us that from that date enforcement agents with view of taking control of our goods in accordance with schedule 12 of tribunals courts and enforcement act 2007. the sum needs to be paid in full within 5 days of letter dated 25/3/14. If not they will visit again at the cost of £235 black bla. Have logged into there website but will not let us set up payment scheme. Help please hope it makes sense to someone. Its our own fault just need to know how to sort it without company bullying u.

Communicate with B&S via the telephone.
Also write to them, copying the council in, advising that you wish to pay in instalments, as per your previous A of E order. You do not have £2500. You will not be allowing the bailiff into your home and will not be entering into a Controlled Goods agreement. Therefore, there is little point in visiting with a view to take control of goods as none will be taken control of. B&S should be aware that councils have been warned about allowing debtors to be forced into punitive repayment plans by the Department for Communities and Local Government.
B&S do not want you to contact them, they want to visit in order to charge you £235.Last edited by The Starving Taxpayer; 28th March 2014, 17:09:PM.

If B & S are trying to mislead you into believing the new fees structure is already in force, they are not so much playing with fire, more throwing themselves into a blazing inferno. Attempting to apply legislation before it comes into force is not only unlawful, in the circumstances you describe, it is downright illegal also.Life is a journey on which we all travel, sometimes together, but never alone.

Complain to the council that Busted & Stupor as the debt is with them now, they cannot apply the new regs, the transitional rules will apply as in they get the account before April 6th OLD RULES APPLY throughout the life of their involment in the enforcement. I would say that maybe LB compliles a lis of these tricks and passes them to Pie-eater Pickles's department for attention.

Since they wrote the letter to you on the 25th of March they can not say that you will be charge £235 for one of their muppets to turn up and set up a payment arrangement that they can (and should - as per national guidelines for Council Tax arrears) do.
They are really silly, if they had waited 6 more days they could have charged you £150 just for sending one letter.

There is a lot of confusion as to whether a bailiff SHOULD set up a payment arrangement or not and this is even more confusing under the new regulations that take effect next week.
Whether an agreement can be set up and over which period is completely reliant upon the contract between the enforcment company and the local authority. Some LA's may insist that they will allow debts to be fully paid up in just 3 months and others 6 months. One contract that I viewed this morning specifically provides that they require full payment within 3 months !!!
In this particular case, has the bailiff ever levied upon any goods?
Also, I would suggest that you call the council ASAP to ask for details of the fees have been applied to both accounts in the past. This is a very important point.
