    Hello guys!
    Having a bit of trouble with JBW.
    Got a letter...
    hand delivered on the 18th of December, at 8am. It has a Attenace to levy fee, attendance to remive fee and letter fee, all totalling to £311.89.
    The baliff never knocked, I know this because my daughter left for school at the time he walkes down the path and she said he just posted and walked away.
    I called and payed £20 towards the balance and set us an agreement to pay £20 a month. Thought it would be ok.
    come February I was bomarded with calls & ect...and they cancelled my agreement. I paid anyway. This month I rang and told them I hadnt been paid and if they wouldn't mind waiting a week..and the responce was basically -tough s**t. Isnt my problem see you soon!

    Basically:
    they have threatend to take my motability car. My husbands car. Told me they can break in and will right down what ever they can see in the window....which apparently gives them to return and break in again??

    I rang today to ask for a break down of fees....and no one would talk to me, told me my case had been handed to an actual bailiff.
    which confused me as I have 'actually' had a baliff come round and apply these fees?!

    The moron on the phone
    wouldn't give me any contact information and only the bailiffs last name and intial. Which is C Gibbs.
    After some ' investigation' I have found out he may possibly be called Johnson Col Gibbs...and this fella I cannot find on the register.

    My questions:
    Can they take my motability car?
    Can they break in?
    Can I pay the PCN to the council directly, and ignore JBW.
    have I been over charged?
    Has anyone had the pleasure of dealing with Mr Gibbs

    From the hand delivered letter the charges I have:
    Starting balance : £95:17
    Attendance to levy fee: £30.07
    Attendance to remove fee: 169.90
    letter fee: £16.11

    Also, this has been typed up before it had already been delivered?

    Am I being f****k over?

    They cannot take a Motability Vehicle
    They may force entry to your home but only after having been in previously by peaceful means.
    They cannot conduct a levy by peering through the windows & in any case I would now draw the curtains & blinds.
    Even the letter fee is wrong as it is £11-20 +VAT = £13-44

        Regardless of anything they may say they have no automatic right of entry.

          Tell JBW and record the call as you do and get them to say they can take a Motasbility car, then send it as evidence in a Formal Complaint to the creditor.

            rang the council today, and they said they wouldn't except payment ove the phone, refused to send a letter stating this....when I asked if I paid online would the balance be cleared and she giggle and said 'indeed'...but I would still be liable for the bailiffs fee's....also I asked for outstanding balance....its £18.40...
            Obviously I have paid this via the councils online payment 'do da' and have a receipt.
            I am considering this matter over as I have cleared up any debt I had for the PCN and the bailiffs didn't do their job as I 'dealt'with it directly with the coucil???......am I right??

              From what I gather from your original post you started paying for the PCN after the first letter from the bailiff, immaterial that they got their figure wrong and made silly threats, if that is the case you are still liable for the fees.

              It's a dirty job, but someone got to do it!

                Irrespective of owing the fees, the bailiff contends he can remove A Motability vehicle, so that of itself deserves a Formal Complant. Perhaps JBW fancy their chances in court with Motability Finance.

                  It is a well known fact that some bailiff will tell porkies, from miniature ones to big great wopping ones.

                  Unless the goon actually removes the motability vehicle there is not a lot you can do.

                  Just take it as part of a learning curve, next time you get a ticket which ou think was given wrongly, send a letter recorded delivery to the Council responsible and after 7 days follow up with a phone call.
