    Hi,
    Any advice will be greatly appreciated!
    I cam home to find my car gone after running around like a headless chicken I noticed a later from newlyn stating that they had removed my car for a PCN.
    I remember receiving a pcn but I recall disputing it and did however i did not receive any letters.
    So the penalty was 202 but the bailiff fees are 647.04 making it a total of 849.04 which is completely excessive.
    The pcn was from Harrow council I checked their website and the pcn was still available on their site, so I paid it off in full the 202.00 and they have accepted my payment and sent me a receipt
    what are my options now? can i get my car back? i am so scared and worried about this please please please if there is anyone out there please help me.
    I need my car for work I am social worker i am not sure if my car falls into the essential user category? please help me anyone.
    I am planning on contacting them on Monday

    Hi Miranda, welcome to the forum.

    Before a bailiff can remove a car on the strength of a PCN they must have exausted all other options.

    There are procedures that must be followed and I would really appreciate it if you answered the following questions.

    1) Did you receive a letter from Newlyn telling you that they have been instructed by the Traffic Enforcement Centre at Northampton County Court to recover an unpaid PCN on behalf of Harrow City Council, demanding that you pay £202.00 plus £13.44 , giving you 7/14 days to settle in full?

    2) Did you receive a hand written letter by a bailiff from Newlyn stating that you now owe £493.52?

    3) After a minimum of 24 hours did you receive another hand written letter from the bailiff stating that since youignored all previous communication the amount owed has risen to £565.34?

    4) After a minimum of 24 hours did you receive a further hand lwritten letter from the bailif stating that the total owed now was £641.11?

    5) before the car was removed did the bailiff speak to you advising that if you did not pay in full he/she would be removing your car at the extra cost of £210.00?

    Depending upon your answers I will be able to give you further advice, however, the car now clocks up a furter £24.00 per day, I advise you to pay the fees and charges accrued so far to rescue your car so to avoid incurring further charges.

    If you have a case then you will be able to claim some or most of the money back.

      Hi thank you so much for your response.
      I received none of the above. Hence my shock when I got home and noticed my car removed.
      So your advice is to pay the fees but how do I claim the fees back?
      Please advise.

        You have to write both to Newlyna and the council. Both letters must be copied to the other and it should go without saying that you should mail them recorded delivery, so you get proof that they have been received.

        To Newlyn you need to ask for a breakdown of the fees and when they accurred, day and time. Explain to them that you did not receive any correspondence, nor contact, and you had no chance of paying the bailiff before the car was removed.

        To the council telling them the whole story and copy them the letter you sent to Newlyn.
