    I have a few financial issues at the moment (personal debt & Ltd Co Director debts). I have been visited on a couple of occassions by Baliff's and today by a High Court Sherriff. When these 'gentlemen' are at my property they are threatening (or in the Sherriff's case, promising) to remove goods that i own (car, tv etc etc). How do I prove that I do not own (eg TV, computer) some of these items as they are actually owned (and been bought by) my wife. We do not have receipts for many of the items. Thanks for any advice.

    Are they there for a debt in your name or the Ltd Co name? Have you allowed them in your home?

      OK... the Sherriffs were here today to enforce a high court writ that was obtained by an ex-member of staff who had won an Industrial Tribunal for non payment of wages. The Ltd Co (I am Sole Director) ceased trading at the end of Sept 13 but strike off has not been applied yet. I cannot afford official insolvency and the Ltd Co has minimal assets. We did let them in as they were going to seize the car as it was on the drive way. The Sherriffs debt is now settled (thanks to my in-laws!) but, we have other Ltd Co debts that may (or may not) be a problem if we apply for strike off. I also have debts from various other establishments (CSA, Council Tax, Cards) - As Jim Davidson said in Big Brother "Roll on death!".

        Unless you have signed any personal guarantees then anyone is going to find it hard to get anything out of your Ltd Co. In todays instance who did the car belong to? I believe you may have been intimidated into paying today & can guarantee you will have paid well over the odds in fees today.

        It may pay you to total your personal debts together and investigate a way they may be tackled - DMP, DRO etc.

          Hi Ploddertom, I haven't signed any personal guarantees at all, ever, for the Ltd Co. The Ltd Co is still 'active'. The car is registerede to me personally. The company has 'assets' of approx £200. My biggest problem is I cannot afford professional advice, we literally have nothing. The Ltd Co has left my wife and I broke and living off benefits. What's DMP/DRO? Sorry for my ignorance!

            DMP - Debt Management Plan - basically someone will handle your debts and negotiate with your Creditors. Make sure you choose a fee free organisation - Stepchange for example.

            DRO - Debt Relief Order - if your debts are less than £15k this can be done. It's like a mini bankruptcy and you are "clean".

            It may pay you to start a new thread about this in the Debt Forum as others better versed than me can offer more help.

              If the car was registered to you personally and not the Ltd Co then the HCEO could not have seized it. I would suspect he was hoping you wouldn't know. You should ask them for a breakdown of their fees.

                As the monies have been taken (by deception?) from someone other than the debtor, can any money be ordered to be refunded?

                  The argument would possibly boil down to a "voluntary payment" I suspect.

                    I suspect you are right, although there was nothing voluntary about it. It was made under duress! I am going to contact the Sherriff's office today, don't suppose i will get very far!
