    hi my name is sarah , and yesterday i received the first letter of marstons saying removal notice , it also says .
    due to client :********council
    fees incurred today .(blank)
    amount to be paid immediately:£1814.27
    due to non payment we have attended your premises today to remove goods. you must make immediate payment to our offices in cleared funds to prevent re-attendance and removal procedures commencing.
    should you fail to make immediate payment we may re-attend your premises and remove goods even in your absence(as in accordance with the law)
    should you be unable to pay in full it is imperative you contact immediately on
    enforcement agent . signature
    telephone number:************

    . so i phone them and left them a message even the council , so this afternoon when i finished work i got a call back from the agent who has said i need to make a payment of £500 upfront to start a monthly repayment , but when i told him it was impossible for me to come up with that money as a single full employed mother who pays everything in full as it stands from being back in work , i said i would pay him £250 as that is the most i can afford and he refused and said if i don't come up with £500 then he will gain access to my property and take my goods with or without me there he has also said i have been charged when the letter he posted says no charges . i have said iam willing to pay but they are refusing and making it hard on me . help please will be grateful thank you .

        Oh, really?

        Unless they had previously been admitted and allowed to make an inventory of goods they wished to seize, they are (presently) not lawfully permitted to force entry to a person's dwelling.

        One might wonder which law they imagine would permit them to do that.

          his name is badly scribbled on the paper and tameside council , the latest update , i went to the council offices this morning and spoke to a woman who was trying to tell me that they can not take the contract off the bailiff once its been handed over , to which i pointed out to the lady that all bailiffs and councils have to work together under the enforcements act of 1994 there for iam telling you iam refusing to pay through the bailiffs and i am not refusing to pay through tameside council , so she then phoned (upstairs)and spoke to a gentleman after a few minutes she then hung up and said he's going to get a return back and that i need to write a letter to state my case.and that my actual debt was £1526.87 and marstons put 287.40 fee for posting a letter WTF?.so when i got home after picking my son up i received another letter through the door , hand delivered stating

          final notice
          despite previous notice (2)and attendance(s)? you have failed to pay the outstanding sums due.take notice that unless full payment is made immediately i shall remove your goods for sale at public auction .

            If hasn't gained entry to your property then he is TELLING . This is common with bailiffs in fact it is probably usual.

              You need to find out what the buggery Marstons think they are doing.

              I assume that you have not allowed any of their oafs into your house, and that they have not levied distress on your motor-car or on your doormat?

              Send them (by email and by Recorded Delivery) letter #1 from the Useful Letters page - http://www.legalbeagles.info/forums/...Useful-Letters

              This is not a Subject Access Request under the Data Protection Act; the bailiff is required by law to leave details of fees incurred and which could be incurred, which he has utterly failed to do. Send a copy to the council - again, by email and Recorded Delivery.

              More lies - he is not legally permitted to do that.

                Good on you Mr Penypidyn (NOT), you carry on digging that hole for yourself, Marstons and the clueless council officials who are wholly liable for the muppets attempts at extortion. now let me see:

                Ignoring a potential vulnerability
                Demanding a payment way way unaffordable for the debtor
                Acting ultra vires, as in threatening to "gain entry" not allowed at this stage
                Formal Complaint to Head of Revenues, copied to council CEO, Elected leader and your MP, who can be contacted via www.writetothem.com

                  as soon as i can get to a scanner i will scan and pate on to here for you to see , i have not let them in my property and don't intend on doing so. even the woman from the council was oblivious to why it should be that amount charged for a hand delivered letter. she reassured me that that was not the outstanding balance that they claimed and that i seek legal advise on how they are going about the matter .i have written my letter to the council and done a copy of it for when i go in and hand them one i will have one signed by them stating they have received it.
                  i understand i got myself into this mess and i do intend on getting out of it but how they go about doing their job is completely unprofessional on both the council and the bailiffs . thanks for all your help your amazing very appreciated x

                    You may have got yourself into this mess as you say but you and others should never be exploited by bailiffs trying to claim for work not done
                    Hope everyone agrees that if a council is offered a payment plan after the first letter/visit from a bailiff they should accept the payments why keep increasing the debt?

                      Some councils get "commission" (ie a bung) from the bailiff company they appoint, whilst other councils have out-sourced their admin functions to Crapita who, because they own those companies, are eager to pass accounts on to Equita or Ross & Roberts.

                      Other councils are simply staffed by inept idiots.
