                The legal aid agency has written to my husband. They have now asked that his solicitor applies for judicial apportionment in order to remove any liability to crown court costs according to the the sectoon of the criminal defence service regulation that I referred them to. We have progress! !

                  Apparently we do not have progress as the legal aid agency will not call off the bailiff while the forms are filled in! I have to make arrangements to pay and reclaim the money afterwards! !!

                    Ask the LAA to specify and quote the statutory provision that requires you to pay and claim back whilst the necessary legal procedure is gone through to quash the Capital Contribution Order. How are you and your husband to know it has not been wrongfully issued?

                    You should ask the LAA to provide you with a copy of the CCO to prove the CCO is valid and they have lawful authority to demand you/your husband pays and you should also ask Rossendales to provide you with a copy to prove they have lawful authority to collect.

                    If they still remain unco-operative I would treat the demands as suspect.

                      Hi a CCO has been issued for approx. £37k based on an assessment that included partners property and equity. The vast majority of equity and capital included in the assessment is partners. My own capital is very limited. Can Rossendales seek to recover debt from assets in partners sole name

                          I am attaching relevant extracts from the Human Rights Act 1998, Emmo. These set out your husband's basic human rights under the Rome Convention (aka European Convention on Human Rights). Because the public's confidence and trust in government agencies and departments is at an all-time low, human rights are becoming more and more important in enforcing your rights and putting the government and its commercial partners-in-crime back in their boxes.

                          I would be inclined to remind both LAA and Rossendales that they are subject to the Human Rights Act 1998 whatever they may think. LAA's conduct may amount to maladministration, so speak to your MP about pursuing LAA's conduct with the Parliamentary Ombudsman.

                              Get your MP involved and use the HRA to your advantage. LAA and Rossendales need reminding they are accountable under the law and must co-operate with any query you may have. I would not fall for their "Pay now and we will refund later" statement. I have a feeling you would find it difficult to get it back, if at all.
