Re: Marston bailiff help needed ASAP
Total outstanding is £370 (from the fine) plus £300 fees added on by Marstons
This print out the court have give me today has cleared it up now & i fully understand the debt. I mis informed you earlier on the job seekers allowance situation and the debt being the total of my fines was £600. I paid £230 out of my JSA the final debit out of that being 27th April 2011
Sorry about that. Ive been doing all this from work & my heads all over the place. Now that ive looked at everything properly it makes sense. Here are the pics of both sides:

So looking at everything properly the balance left to pay was £370 when my benefit stopped & i started work again. No-one was informed so thats why the court sent me a further steps letter in November 2013 asking for £370 then that wasnt paid on time, like i said i tried ringing the number provided. Thats when Marstons have got involved asking for £370 + £85 costs this year. That wasnt paid because they didnt wana know about installments because i cant afford it now its up to the red letter final notice for £670
Looks pretty crap now

1. I have not got a clue. If I was, i would of attended & realised i should of made them aware I was now off JSA & workingOriginally posted by CleverClogs View PostThank you.
It still does not make sense, though:- Why weren't you arrested and hauled up before a court for defaulting?
- Why were you fined such trivial sums for "theft from a motor vehicle"?

Re: Marston bailiff help needed ASAP
Again i have not got a clue about them
my question now is the bailiff, whats the best to do after sending off the statutory dec to them?
he might just keep turning up unannounced & adding fees every visit!!!

Re: Marston bailiff help needed ASAP
Marc,
- Paying the outstanding portion of the consolidated fines - £370 - into court will settle the fine account. It will not cancel the bailiff;
- The £300 fees being demanded by Marstons are lawful and the maximum they can lawfully demand unless they have to force entry. They do not have an automatic power or right of entry - Heaven forbid if they ever did - and must obtain authorisation from a nominated officer at the court that issued the distress warrant;
- The £300 fees are lawfully due to Marstons and should be paid to them directly.
Hope this helps.

Sorry - I had misread the printout; the fine was £65 with an additional £15 "victim surcharge".Originally posted by L11Marc View PostAgain i have not got a clue about them
Pay the buggers some money. Unpleasant as it may seem - and I'd agree that their lawful fees are rather too high - they are legally entitled to that money unless you can shew that the court slipped up in some way. As they sent you a "Further Steps" notice which you ignored, you are rather stuffed.my question now is the bailiff, whats the best to do after sending off the statutory dec to them?
Unless he levies distress on your vehicle or on your goods and chattels - rather than anything owned by your mother - it is difficult to see what other fees he could impose.he might just keep turning up unannounced & adding fees every visit!!!

So perhaps he'll levy distress on a neighbour's motor car and claim that it belongs to you until/unless you can prove that it doesn't.Originally posted by L11Marc View PostI dont have a vehicle or goods at the address apart from clothes
Absurd? Why, so it is, but that's the sort of trick bailiffs do to garner fees.
How charmingly naive!hopefully this will lead the bailiff into helping me out a little with a payment structure

Re: Marston bailiff help needed ASAP
Bailiffs acting on behalf of HMCTS are expected to use their commonsense, though the chances of finding a certificated bailiff with any is about as likely as finding a Borismaster bus on the Moon. HMCTS are aware that money is tight and if a fine defaulter asks to set up a payment plan, this should not be unreasonably refused.Life is a journey on which we all travel, sometimes together, but never alone.
